Damn. 🙁 It was an accident that nearly hapenned 2 years ago. Exactly as the word describes... an "accident."
I was pretty much 100% at fault (I believe I fell asleep at the wheel... it's not like I know I'm doing it... it just happened)... so naturally this is all claims and settlement which would mean I don't have to go to court. But their freakin lawyer thinks I still may have been negligent (wtf?) even after the deposition. He kept asking me if I had a history of blackouts, if I drank alcohol, if I smoked weed (lol)... uhh right.
So if you have some Jurty Duty in southern california regarding a car accident. 😉😛
Geez, right in the middle of the school year.

No offense, but if I got injured and my car wrecked because some dumbass fell asleep at the wheel, I'd be pissed off too. "Sorry, I didnt mean it" just wouldnt cut it.

$120,000? She wasn't hospitalized or anything.
Insurance said they will cover me up to $100,000. Anything over I have to pay... but I'm a freakin college student. What funds or assets do I have? Maybe they'll take my computer. 🙁

you should definitely let your insurance company know about the lawsuit and you should also look into getting a personal lawyer.

I admit fault. I was not negligent. It's not like I knew I was going to fall asleep, I did not believe I was going to fall asleep, and I was not tired beyond the point of driving. I believe most people who fell asleep at the wheel can testify to that. I truly do feel sorry for the person I hit, and I was scared as hell after the event. My insurance would pay up to $100,000 but she wants more claiming I was negligent.
So they will get $100,000, that's close enough.Originally posted by: Gr1mL0cK
Insurance is taking care of this.. theya re the ones that hired the lawyers. They are covering up to $100,000 only.

I have to disagree. I would certainly consider falling asleep at the wheel negligent. Given the fact that the insurance company is only going to pay $100K, you may wish to seek the counsel of a lawyer independent of the insurance company. Check with your school's student services; you may be eligible for consultation with a lawyer for free through them.Originally posted by: Gr1mL0cK I admit fault. I was not negligent. You probably don't have any assets but if your parents claim you as a dependent, any lawyer in this situation would go after their assets.

I don't see how that's going to work, considering he's of legal age. Being a dependent for tax purposes wouldn't matter.
