My process took extra long because 911 happened during. By the time I got my conditions removed I had already been in the us for 7 years (instead of 2). Then I naturalized, apparently without noticing it would have to be renewed if I didn't. But the other remarks I made should be accurate, re how it's lost.

Yup, us brown folk applied for citizenship in droves after 9/11 because there were rumors that GWB's administration would change the naturalization process. I knew plenty of Indians like my parents who came over in the 60s for engineering degrees, got jobs, got permanent status, and never bothered to become American or Canadian citizens (holding Indian citizenship made traveling back and forth to India and owning property in India easier.) I actually took my oath on 9/11/2002.

All you do when you naturalize is make an oath disavowing allegiance to any foreign prince and some other symbolic bullshit. You don't lose anything. The US ignores multiple citizenships. Maybe your own country won't, but the only way they'd know is if you'd tell them. When I went back to my country they weren't interested in my US citizenship. The banks were, however. It's a life-long curse. This guy is probably lucky.

It was either because he lied during his residency application, re the two convictions, or because they later decided that those two convictions warranted removal. Residents without criminal records and who don't commit fraud can't be targeted.

Yeh, 26 years after the offenses occurred. It's what we call chickenshit. There needs to be some sort of reasonable standard applied with really old stuff & this isn't it. There needs to be some statute of limitations.

if he failed to disclose the convictions then it makes perfect sense to remove him. Just like it would have made sense for him to not have disclosed it. He probably couldn't. It would also explain why he couldn't naturalize.

There's the two convictions, which by their nature taken together together could make one removable (fraud/dishonesty elements). Then there's the possibility of fraud in the application process as well.

ICE makes none of those contentions. They obviously wanted to find an excuse to deport Niec over a string of minor offenses & allegations & had to reach back 26 years into his juvenile record to find cause. We all know that's not right even if it's technically permissible.

People get 10 years for using ice. You can call it an abuse of discretion, and I would too, unless it was for not disclosing the convictions. I wouldn't have disclosed them either, but also think that anyone who doesn't should be removed. The good news is that Poland's quite nice, and they'd recognize his md. Kalamafuckingzoo?
