Lindows Wins A Small Victory Over MS !

Microsoft can't win this one, I trademark office already refused Windows as a trademark.
So I doubt that court will go back on that. And also with all the evidence I've seen on the case only a
really dumb judge would do that. Of course he could be smart and still do it.........

who cares - MS wants to bring them into the dirt with legal fees, etc.

they're obviously not going to win...stupid civil law.

Anyone that lets MS trademark Windows just isn't thinking clearly.

What do we look out of when we want to see what it looks like outside? Windows.
What are the boxes on a GUI called? Windows.
What is the time during which something can be done called? A Window.
What do we call just about anything that lets us see through or into something? A Window.

If a word as generic as "windows" can be trademarked, what's to keep Disney or AOL Time Warner from trademarking the entire English language? And what happens then?

well maybe they will leave it alone .. Ballmer, the crazy guy who yells like a madman, said in a conference last week or so that MS will try to be more responsible and less underhanded as a business than it has in the past .. of course thats just what he says ..

Really they said that !? I guess Ballmer doesn't know when to shut-up if he said that because if he did then he is admiting to Microsoft has used under-handed tatics when dealing with competitors. Something which they have denied in the past.

During the trial this was all brought out and Microsoft was found guilty of monopolistic tactics. The idea that they used underhanded tactics is now industry common knowledge and fact. Balmer isn't admitting anything that isn't already known.
