Yes, should look both ways etc etc......however, if the car had hit her, the Driver would be in deep shit. The Driver bears far more responsibility in this situation.
Yea well she would most likely be dead or seriously injured. Never rely on someone else with your life in times like that.
 
It is common sense that one should look when crossing a street, yet beyond the grasp of some that seem to think a law is going to prevent them from becoming road kill.

Not even so much pedestrians. I watch a lot of car crash videos (here) and the total lack of defensive driving by other drivers is astonishing. Drivers are watching others drift into their lane and their machismo gets the better of them and think "they won't... " and then they do and they're out a month without their car and a giant headache to deal with. But hey, they had the right of way so I guess they won... /eyeroll

I'm conflicting about hoping that the driver was texting or was otherwise preoccupied that they are oblivious to the fact that they almost hit that person. Almost hitting them is a big enough scare to seriously weigh on their conscience. On the other hand being aware they almost killed somebody might be the scare they need to correct their bad driving habits. But if they are generally a good driver, it would be nice to live without having a scare like that.
 
While pedestrians have the right of way in a crosswalk, it is just common sense to at least glance in the direction of on coming traffic to see if a car is coming. I guess one could see this a "blind" faith drivers will stop, a practice where you might end up "dead" wrong.

That's just it, stupid people have invented things like "pedestrians always have the right of way"... which first off - is bullshit. They have the right of way at designated crosswalk areas during designated times. It's just baffable that people will cross live traffic without looking for 4-ton vehicles that could plow you over at any second all under the guise of "Dur hur I'm a pedestrian I gots da rite of wai". Whatever, brain cells that don't look for huge moving vehicles in huge moving vehicle designated areas are ones that shouldn't be passed on.

For the record, I get it - the woman has the right of way here - but if you think that means you shouldn't look for a moving object in a moving object area, you're just as stupid as someone that jay-walks.
 
wow. the camera on that Samsung Note is insanely good!
with my dashcam, i cannot read license plate while in motion. seems to be a problem with every dashcam. but off course, license plate is legible when not in motion...such as at red lights.
 
that guy stopped way too soon, giving the lady a false sense of security. then the idiot doesn't look while crossing. the guy would have been at fault but that should have been avoided

Agreed, but she's still the real loser here for being less aware of what is going on. The law is kind of meaningless in these situations when the pedestrian really has far more to lose in such confrontations.

Responsibility/shmesponsibility: She still comes out of that situation missing a few pieces, or in a body bag. That's no way to be.
