No, you're wrong. This HAS been tested and there is a built in surcharge on Cassettes, CD's and other "recordable" media that allows for a payment to the Harry Fox Agency to be distributed amongst the top Recipients of Royalties.

what if i hook up my FM radio to my tape player and record a song and then hook up the tape player to my computer and then convert it to a mp3 and then put it on a cd to listen to it, is it still illegal?
Technically, this is not a FAIR USE, as you have not paid for the song. And broadcasts are not to be recorded or re-broadcast without express consent of the holder of the license to broadcast. That would be the radio station. Ever notice how Radio stations have quit with the complete broadcasts of anticipated albums? This is why.
Fair Use = Owning the music, etc in question and simply changing the medium.
Not Fair Use = anything else
