Air, you report it to the insurance company.

They are usually more than happy to increase their rates because of things like this. Also, Texas must not give a shit about these things.In NY/NJ, you look funny at another persons car and you can get blamed for damages! ;)

Why does the op care about the insurance being lapsed AFTER the accident occurred during the policy period?

Here's a potential reason:

I'm not sure if it's the same in Illinois, but I know in NYS if you don't maintain valid insurance on your car without turning in your plates, it's a fine and/or possible suspension of your license - REGARDLESS of if you have the car on the road or not. If it's got tags on it, it has to have insurance on it.

Why would this matter to the op? Because if the car CURRENTLY doesn't have valid insurance, then he could be cited for it regardless of the hit and run if he talks to the police.

That said... the OP *has* stated that he was not involved in an accident on May 5. If that's the case, then he has nothing to hide. Talk to your insurance carrier, talk to the police, look over the car for whatever suspected damage might be there. If there's damage, then you were in a hit and run and you're lying. If not, then the burden of proof is on the accuser.

They didn't care that she owned the car that hit my car since I couldn't prove who was driving it. The judge even said something to me about life not being fair or something to that effect and somehow despite knowing their car struck my car they couldn't do anything for me.

I would call shins on this (Owners are responsible for damage done by their cars) except for the fact that small claims court is the Wild Wild West of the law. Usually, judges there only get it right due to luck.

I had an asshole hit & run my 2 day old car several years back. I found their car the next morning at the end of the street where they'd parked it a few inches from their fence in order to block view of the damage to their car from the street.

The police didn't care at all and didn't help out.

I took the cars owner to small claims court and they had a lawyer come showing a passport stamp supposedly proving they were not in the country when my car was hit... and that was it.

They didn't care that she owned the car that hit my car since I couldn't prove who was driving it. The judge even said something to me about life not being fair or something to that effect and somehow despite knowing their car struck my car they couldn't do anything for me.

how do you know that car hit your car?

There was a post on another board about this. Person got a call from the cops that his car was in a hit and run. The person said he wasn’t in any accident. The cops then asked if they could come over, and look at the car. The person said ok, and the cops looked at his car ,and said that his car doesn’t look like it’s been in an accident, and the cops wrote it down that it was the wrong car. What happened was the witness gave the wrong license plate number.

That's exactly what would happen with any normal person being accused of a hit and run.
