Illegal? Not sure. I smell a civil lawsuit coming over it though if this ding-a-ling posted the pictures up someplace.

Is the "butt in question" :D identifiable as this girl? Guess you couldn't have much of a case there if it's what appears to be just a random butt captured in it's natural environment. :D

Technically, if no one could ID the pix he took, he could theoretically argue that he got the pix from somewhere else. ::shrug:: I don't know enough about this case, but that seems to be a (albeit very THIN) loophole.

It's the same concept as paparatzi (sp?) taking pictures of celebrities. Anything in a public place is public domain. I don't think it is or should be illegal to take pictures. However, if the guys were hounding the girl and actually harrassing her then something should have been done.

This is coorect, in public your picture can be taken and used for whatever purpose AS LONG AS it is not altered in a way as to defimate or (falsely) slander.
Up skirt pics and vid is illegal because it was ruled as taking images of "restricted" "hidden" areas of the body, thus not "public domain"

2 years back I took a photography class at school. Things might be different now, but this is what we were told:

It is illegal to use for both personal use AND to distribute for profit or whatever as long as you weren't doing anything illegal when taking the pics. So, I couldn't, say, break into a random person's house, snap a pick, and then sell the pic later because I commited a breaking and entering crime. However, say I'm on a nude beach, I could take pictures and sell them to porn sites because I was not breaking any laws (although most places I would assume have no pictures rules). Think "Girl's Gone Wild" vids, I'm assuming thats how they get away with that, although they may ask for permission after the candid shots (doubtful though).

Of course, even though it's not illegal you can be brought to civil court, and say they caused emotional distress or something, and for the nude pics sold to porn sites you could probably win even, not really sure.

BTW, we were told the above not for porn purposes, but so that if we, say, were taking a pic of a monument we didn't need to pay royalties to any random passer-byers or the such.
