My friends who is quite dear to me is in a quagmire. They recently bought a house in New York City. Now housing prices in New York is extremely high, so in order to pay off their loan they began to rent out a room to local college students. One person came and after leaving she introduced someone,(whom I will refer to as Miss X) to my friends.
Miss X when she came was nice and she paid a monthly rent. Now my friends have 5 kids, 3 who are growing up to their teenage years. For a year my friends had asked Miss X to move out so that their children could start using the room. Yet Miss X kept on braking her promises and now the situation is becoming out of hand. Miss X is threating my friends to sue them for renting out the house to her illegally. My friends are not very rich nor do they want to go to court. What can they do in this situation?

Landlord/Tenant laws vary drastically by state, so I would have them contact an attorney. If poor enough they can contact legal aid.

I know some renters law in PA, maybe it will appy to NY as well. If there is a lease signed for a period of time, the landlord can only evict someone if the break a major part of the lease, like not paying rent. If there is no lease, just a spoken agreement, then its still a contract but it more difficult to hold up in court. I dont think that an eviction notice can be executed in less than 30 days.

I dont think you can rent out a place illegally, as long as they are paying taxes on their income that they generate from the renter.
