I bought a mobo from newegg a little while ago that arrived doa sort of - it worked but once you shut off the system the bios wouldn't reset or whatever and it wouldn't POST. Newegg said that the mobo was warranted through the manufacturer only, but asus said go through the retailer. I emailed newegg asking about what to do and within a couple hours got an RMA number. Newegg gets  from me for that
Although, if the item specifically said "This item is warranted through the product manufacturer only" then you should know that before ordering. If that is their policy about that particular item and you don't agree with it then buy somewhere else. Not every item is labeled like that, but apparently that one is one of them. Sorry, but that's the way it is sometimes.
I don't know why people don't pay attention to stuff like that and then complain when a company follows their policy
