I agree with the author, this IP isnt worth fighting over.
Game copyrights are only worth something if you occasionally make a game out of them. Nobody has made an original game for Duke in 9 years, and THAT game was legendary for its delays.
I guess it must be damn near impossible to invent a new franchise these days. Apparently billion dollar companies would rather fight over the rotting food in the trash because table scraps are just too difficult to get.

rotting food is putting it mildly if we're talking 2011's game... Gearbox will never redeem themselves for that atrocity
 
I liken game publishers to be more like Prison gang Lord's. They have their press gangs of devs and their turf marked by their franchises and if another group tries to move in on a corner of their turf, it stops being about the thing and starts being about respect and they shank each other.
