LAPD To No Longer Comply With Feds On Immigration Hold Requests

I don't think this is a bad thing. I never understood why our government would ask to detain these people for long periods without any justification or trial or warrant, etc.

LOS ANGELES (CBSLA.com) — The Los Angeles Police Department will no longer comply with federal immigration detainer requests issued without judicial review, Mayor Eric Garcetti announced Monday.
The Police Department will now only honor requests from Immigration and Customs Enforcement to keep someone in custody if there has been a judicial determination of probable cause or a warrant from a judicial officer, Garcetti said.

“The federal government is in charge of enforcing federal immigration laws, not us at the local level,” Garcetti said in a speech at City Hall. “That responsibility can’t be forced onto local law enforcement officials who already have stretched budgets.”

The Mayor’s office also took to social media with several tweets underscoring the policy announcement.

Police and city officials have been under pressure from the Department of Homeland Security (DHS) to hold on to illegal immigrants arrested for low-level crimes.

In October 2012, LAPD Chief Charlie Beck announced the LAPD would no longer grant an ICE Detainer Request “without first reviewing the seriousness of the offense for which the person is being held, as well as their prior arrest history and gang involvement.”

The move came after the City Attorney’s Office advised Beck that honoring requests made by U.S. Immigration and Customs Enforcement (ICE) were at the discretion of local police departments, Beck said at the time.
Beck voiced his support for Garcetti’s announcement on Twitter, saying “There’s nothing more important to a police department than community trust.”

Steve Soboroff, president of the Los Angeles Police Commission told KNX 1070 NEWSRADIO he and other officials remain reluctant to detain people solely due to their immigration status.

“The idea of having the government calling and saying, ‘Hold him another 48 hours for this specific purpose’, to me, I would like not to do that,” Soboroff said.

Police arrest about 105,000 people per year, and the LAPD receives ICE detainer requests for about 3,400 of them, according to police data.
Los Angeles police are the latest in a series of law enforcement agencies to stop honoring immigration detainers since a federal court ruling in Oregon found a woman’s constitutional rights were violated when she was held in jail without probable cause.

California had already moved to limit cooperation with immigration authorities on detainer requests under a law that took effect this year.

Excellent! Looking forward to the day when we can all ignore the law. It's definitely going to take day to day living to a whole new level. You'll really think twice before changing lanes or even going out to get the mail. We can all just pick and choose which laws we feel like obeying on any given day. Thanks Obama!

Perhaps you should read the articles you post?

Yes but they have to have cause to hold an illegal for extended periods. The federal government is not following the law and that is why you see California bucking from Obama's orders to hold illegals for extended periods. They have to have some legal justification for doing so. If you read further in that article, California got hit with a major lawsuit for holding a woman for an extended amount of time without due process of law, or justification.

It is the Federal Govt who is not following the law here.

They aren't going to let them run free, they will deport them out. That is what they want to do is get them out not hold them indefinitely.

It's funny because that is exactly what the conservatives are asserting. That Obama is keeping them to protect them from deportation... that is there reasoning. So when he asked various states to set up detention camps a bunch of these conservatives flew into a tizzy and forced buses to be turned around.

Here we have one state saying enough already. We aren't going to keep holding them, which then forces them to be deported out immediately. They aren't just going to let them all go free..lol

Oh well, damned if you do damned if you don't eh? Obama can't do anything right.
 
I dont like illegal aliens, but they need to be treated like everyone else where due process is concerned.

I also have a problem with Guantanamo Bay but people seem to have forgotten about that.

They are holding them so they can be deported.

Seems okay with me. After all, the E in ICE stands for Enforcement. Let them do their own enforcing.

Really? I'm pretty sure there's a rather distinct difference between a federal agency who's responsibility it is to do the detaining and deporting versus a business who's responsibility it is to nominally follow state and federal statutes on hiring practices. Private businesses don't detain and deport people either.

Try harder next time.

ICE is responsible for Immigration and Customs Enforcement, hence their rather fitting agency name. If that's their job, then they're the ones that should be ... you know ... enforcing.

Seriously, stop trying to conflate the issue into something it isn't. Private business hiring practices versus immigration enforcement are different pages in different books.

I am saying that if the LAPD can freely ignore enforcing immigration laws, then so should private businesses. Leave it up to the ICE right?

They aren't letting people go either. ICE has to come and get the people that they are no longer detain past the reasonable amount of time set by law. If they are in fact proven to be an illegal. If they are illegal immigrants then ICE has to do their job. What is happening is ICE isn't doing their job atm. They are asking states like CA and Texas to set up permanent detainment centers to hold folks past the period allowable by law.

I suspect that Obama might be looking to give haven to all the children who are coming here in droves atm and is trying to figure out what to do. He is buying time. So he has ICE ask the states to hold these folks longer and longer, which turns into months.

That is why California got hammered with a lawsuit and lost btw. Go look it up. A woman who was suspected of being an illegal immigrant and harboring drugs was forcibly detained and kept for months in a jail cell. She filed suit and won.

You are also forgetting their is due process of law for people who are suspected of being an illegal immigrant. They might not be an illegal, but many legal citizens do get caught up in the net of ICE and get held for a period of time till they have their due process and trial or what ever is required to prove they are legal, or haven't done anything illegal.

Sigh.. I am getting tired of typing to a 12 year old. So I will let someone else deal with you now...
