He most likely didn't cause any damage. It probably is the landlord trying to stick it to him. I don't blame the landlord. Fvck the communist/socialist rules & regulations regarding renting there. You leeches deserve Hillary and her ilk. And, now you worms want to saddle the rest of the country with Kerry & company?

The rest of the country, who aren't crammed together like sardines, don't want your Communist/Socialist agenda! :|

You serious? Have you forgotten the storm already?

It's pretty obvious to me that the OP left the window open from the kinds of questions he's asking. Think about it, do you remember seeing water on the wall and floor when you closed the window or not? That sort of thing would probably stick in your head, because you would (or should) have gotten towels to clean it up. So obviously you know if you closed the window before or after the storm.

Are you the guy whose girlfriend owed money to a collection agency and had a default judgement against her?

Edit: Yes you are. How'd that turn out? Did they end up suing her again?
Edit2: My bad, it was the cable company that got the default judgement because she was stealing cable.

Fvck you. This is EXACTLY what's going on. The landlord is trying to reap some kind of payback for this rent law injustice. Doesn't make it right... but then again good for him!

They can't sue you successfully without evidence. Don't give him any. It's a case for small claims court anyway. Just tell him that the roof leaks.

Water damage doesnt happen in the blink of an eye without a major flood. Tell him to show you photos. If it looks like any wood has rotted, the damage has existed for a while. No photos = no lawsuit, especially since the repair has already been done.

So let me get this straight...you are opposed to Communist/Socialist ideals yet you don't blame the landlord for trying to to stick it to the renter who didn't cause the damage? Sounds like you're a big advocate of personal responsibility to me. Let's just stick somebody else who doesn't deserve it with the cost, because that's not a socialist philosophy at all. btw, I highly doubt water from one rainstorm would cause damage to 4 floors. Especially in NY. We didn't get *that* much rain. That would take an insane amount of water to seep its way through the floor, out the ceiling, into the floor, out the ceiling, into the floor...


Now, if there's a drain pipe that's clogged, I can see there being damage from a much higher volume of water caused to go in the window, or perhaps down the inside of the wall.

Eh, it's a normal day here at AT. I just like to think of Ornery as a herd of cows we keep for fertilizer; every once in a while we just need to break out the cattle prods to keep him in the right pasture. ;) :beer:

I was able to get the default thrown out. Then to my shagrin, she then prompty accepted their first offer to settle the case out of court. Its all history now and she is making paying off the debt.

I am going to get a lawyer for my water damage problem. Thanks for your replies.

As soon as there is a threatening letter that's bigtime illegal. I'd definitely get a lawyer. And it depend son the state but some places have a law that if the landlord witholds funds or charges you for extra things, they are liable to refund your twice the amount. But I'm not a lawyer so call one quick!
