Even stupider, in fact -- she's suing because she says the mall security didn't rush to make sure she was OK, even though she told someone nearby she was fine, and just a little wet.

However, I believe this is a R from OT.

So she's suing for injuries she didn't have? That's awesome. I wish I was on that jury.

This case is real weak. She sustained no injuries. This action was entirely on herself. And though the video was posted. The only reason she is identified is because she came forward.

Good luck. Hope the judge hits her with the malls legal fee's to make an example of her.

Lawyers are getting desperate watch your back. Must have something to do with huge unemployment and 250,000 loans in the sector I was reading about. Problem is lawyers are judges too so you never know what will get traction.

In my mind she is suing for the mall's stupidity in posting the tape on you tube.

But even then, no views are close ups so she could have been any idiot. When she comes forward to admit she was the real idiot who stood up, she self identifies herself as the idiot in question. So the fault lies not on the mall, the self embarrassment fault is solely hers.

In short, in terms of having any court case, she is all wet.

They either need to put up razor wire around the fountains to keep the idiots out or make the fountains deeper to keep them in.

I think that we need a system where if a case is deemed frivolous both the plaintiff AND attorney who takes a turkey case should be fined.

In the video she says that she hasn't sued the mall. She's considering her options. That attorney there seems to be her criminal lawyer.

I think that we need a system where if a case is deemed frivolous both the plaintiff AND attorney who takes a turkey case should be fined.

Loser pays would fix our whole legal system.
A) people would think twice about bringing frivolous suits, the classic $15,000 slip and fall companies pay rather than fight since lawyer costs more.
B) the little guy/entrepreneur getting sued by the likes of unlimited budget mega behemoths, basically get out of our business lawsuits, would stop because if case had no merit lawyers would take case for huge payment on back end.

The fact is you are on camera almost anywhere you go in public, may not be right but it's the way of the world. So if you don't want to be embarrassed you can either stop doing stupid shit like walking into a fountain or dumping a cat into a garbage can or don't go out in public.

As some others have said no one would ever know who she is except her friends and acquaintances, she brought this on herself.

The recording of her was in a public place... it is 100% legal to record people in public places and then distribute said recording; There is NO expectation of privacy when you go out in public.
