This one, in my opinion, is a case where is a very fine line between self defense and murder. And its all contained in half of a sentense, "She removed a firearm from a drawer and told the subject to leave, but he did not, so she fired, striking the subject in the head."

And usually the test is does the suspect have a weapon and is the suspect attacking.

Asking the suspect to leave, and upon refusal immediate firing lacks the moving toward her of a attack or the running away that would constitute murder.

If he was sober/intelligent, he would have turned and run. Maybe got away.
If he was stoned/stupid, she'd have another shot at him.

I would be in shock actually.
I picture the guy's back was turned towards her and is she just shot him in the ass, I could only imagine what his reaction would of been.

I picture the scene in Training Day when Denzel turns around and shouts, "You shot me in the ass, jake!".

My assumption is that if you break into my home during the 12-14 hours that I occupy it, that you are doing so with the intent to attack me. Otherwise, you would have broken in during the 10-12 hours I am not in the home.

She gave him a warning he did not heed so no murder found.

Firearm opinions all aside, how stupid do you have to be to NOT leave when someone pointing a gun at you asks you to do so?

Unfortunately the only one who's dumb enough to answer that question has already assumed room temperature. One of life's great mysteries continues unsolved...
 
The woman is obviously lying. She likely shot him with no warning, given the conditions, he might not have even realized she was armed or even at home.

A human life was just sacrificed to preserve this woman's materialistic wealth. Who knows what the loss of this man's life will do to his friends and relatives?

People taking the law into their own hands, like this woman, should be prosecuted as murderers. Private citizens cannot act as judge, jury and executioner at the whims of their itchy trigger fingers, it bypasses every principle that our country was founded upon.

The conservatives in this thread are showing their true colors via their blood-lust and their disregard for the sanctity of life.

Oh yes, and ban scary assault rifles and high-capacity magazines, despite the fact they were not involved in this incident.

On a more serious note, this woman saved the tax payers some money and removed a thug from the streets. Anyone breaking into someone's home should know the risks. He rolled the dice and lost. Glad the lady is safe.

Why even give a warning? In castle law/doctrine states. shoot first, ask questions later. Don't want to give away your position if you don't have to.
 
1) who fucking cares why she was up?
2) he was in her house. not his..he had no right to be there
3) he had long enough for her to load and aim.
4) WTF? call the cops first? are you fucking stupid? sure she can offer him tea while she waits the 15 minutes for them to get there..the cops have no duty to protect you.
5) gun is $300 a alamr system cost more then that. not just in setting it up, monthly payments and such

Exactly. She went beyond what was required. Just pointing out LL's horrible characterization of borderline murder. According to him, she should have baked him cookies while he robbed or attacked her after which she should have shooed him away with a broom.

It would delight me to see that they attempted to sue her, and her lawyer counter-sued for new carpeting, etc. (With her winning and them losing, of course.)
