Knowing and following the law, still get assaulted and arrested

Guy at the train station playing his guitar and singing....cop comes up, tells him to leave. Guy quotes the law saying what he does is completely legal. Crowd applauds him for standing up to cop.

Cop looks law up on his cellphone, reads law and finds he is wrong, and it is legal. Comes back with another cop, assaults man (hits him in face with his own guitar) and tells him he still has to leave, and arrests him anyway.

So it's legal, but the cop didn't like it, so he assaults an innocent man and arrests him.

Now, I am sure our police apologist will come in and hand-wave this away, or claim it isn't right, but doesn't happen often. But if that man had hit the cop in the face with the guitar, he would most likely be dead, or at least severely injured from the beating the cops would have given him.

So I am sure this cop will be charged with assault, since clearly no crime was committed, and the guy was not resisting arrest. Right? Right? I mean we have been told that cops will get punished just like us right? Right?

Seems like the performer was in the right. If so, the cop should be fired and charged.

I will admit that NYPD has major issues. I know quite a few former NYPD and there is a reason they no longer wanted to work there.

i dont get why (assuming everything in the op is true and just as stated) that the cops can't get thrown in jail for assault with a deadly weapon (heavy object to the head - could be fatal with 1 shot), kidnapping (they arrested him with no legal right) etc?

based on that these cops should lose their jobs, pensions and be in jail for at least 5 years in mid-high security prisons with the rest of the scum. then let the victim sue them and the PD for civil damages too.

if stuff like that happened maybe cops in the US wouldn't be such total cunts!

As a NYC taxpayer, I get tired of seeing NYC pissing away taxpayer money settling lawsuits because of idiots (see: NYPD and Riker's Island in particular). And then the gall of it is that the people instigating the lawsuits in the first place continue to work for the city (granted, the decision to fire should be taken on a case by case basis, but it should be happening more than it currently does, especially for the most egregious offenses).

Cops have pride like the rest of us. He didn't like getting owned, so he assaulted the guy. Makes perfect sense. Primate is primate.

,.. agree that this indeed a case / situation of police brutality and abuse - no bones about it.

Not that anyone will listen, but, here is a run down of how I view the issue of police brutality/abuse:
1) Do as they say - period. Because the police WILL kill you. Whatever stand you feel you need to make (because one one pushes YOU around :rolleyes:), let it go - otherwise, you risk the possibility of getting gunned down and killed.
2) Don't break the law - obey the speed limit. Pull over when told to. Show up to court. Give them as little reason as possible to come down on you.
3) Don't push/touch/spit on a cop - I still can't figure this one out for the life of me,...
4) So, you've done nothing wrong (you followed everything, to the T, in points 1, 2 & 3) and they are now bashing your skull in - well, yes, this (like this story) is indeed a case of a crazed, deranged animal that should not be a cop. But, he is. So, provided you survive, look forward to a nice settlement/lawsuit.

Yes, there are cases where things are very bad - but, most get to very bad, because people just don't follow / do 1, 2 and 3.

Anything after that, yes, rage against the machine all you want.

If you've read Bober's past posts (which it would appear to some degree you have) then you're quite aware that using intelligent logic is lost on him. He'll probably instead come back with some 3rd grade level profane insult.

From the news article, the musician directed the officer to the Transit Authorities rules on performers and not the actual NYC law. This is a quote from the news article.

But the MTA rules differ from state law, which says entertainers can be arrested for loitering in a transportation facility unless they were specifically authorized to be there.

So a bit of gray there. I think the performer acted a bit too smug thinking he was in the right, and the cop did react badly. Not sure what side I am on in this one per say. The cop, even if he was just following the anti-loitering law, should have been able to articulate that correctly and just made an arrest without resorting to bashing the guy with his own guitar. That was completely uncalled for and behavior unbecoming an officer. However, the performer was technically breaking the law and not following a lawful order given by a police officer as well.

Heh, I admire your optimism.

Cop was acting like a typical thug who hated being shown as wrong. Thank heavens for that cell phone video, and the person who took it will surely ensure that the guy arrested has access to it.

More or less a cop has to just pick you out of a crowd and beat you to death while laughing to get prison time. Even ones who clearly make up evidence to get people prison time are still employed.

Videos are beautifully illuminating what was surely a problem since the beginning of time: the rife corruption of police and abuse of power.

Very few people are worse than Hitler. You do have to have an above average level of personal evil to be a conservative (some who vote Republican are just misguided and not actually conservative). To actually be in office as a Republican it has become entirely necessary to be possessed more of evil than of good, that much is obvious. The funny thing is I used to not be of this opinion, it's pieces of filth like you that make me feel otherwise.

I don't like conservative ideology in general. But I've been able to have logical discussions with a few on here. Bober is just a bad human being and I believe legitimately developmentally disabled.

Remember folks, it's just one or two bad apples.

The fact that 99.999% of employees of law enforcement agencies didn't piss you off today means nothing?

If 1% of sworn personnel are "bad apples", that is approx. 7,500 bad apples. If 99.9% are good, that still leaves a pool of 750 to make a news headline each day in the U.S.


If you get outraged by one officer per day (about the rate of this forum), that means over the course of a year you have been outraged at 0.05% of the sworn personnel out there. What's your multiplier for how many "bad apples" there are per one news article written? 10x? 100x? If you use a 100x multiplier that still means 95% of them are good.

They are taught to hold their laughter until the weekend at the FOP hall where, before heading home with their partner's wife, they can have a few beers and crack jokes at the noises people make after getting beat and shot in the face.
