"Knock out" game with a happy ending - 65 senior shoots attackers

You've heard of the new game where young people attempt to knock out a stranger and post the video for hilarity on the intarweb? Only this time they attacked a 65 year old man with a means to protect himself.

The cyclist was riding on the Thun Trail near the Bertolet Fishing Dock at S First Avenue and Chestnut Street in West Reading, Pa. around 11 a.m. when the minors -- described by the AP as 15- and 16-year-olds -- knocked the man off his bike, police said.

As two of the juveniles attacked the man he pulled out a handgun and shot them, cops said.

One of the boys died at the scene while another was taken to the hospital with a gunshot wound, officials said.

In most states, if you kill somebody in self defense they can't sue or be held civilly liable. Pensylvania's castle doctrine applies outside of your home.

On Tuesday, June 28, 2011, Pennsylvania (PA) Governor Tom Corbitt (R) signed a bill extending that state's traditional castle doctrine protections to assaults outside the home. The new legislation passed both houses with overwhelming support and expands the state’s castle doctrine and stand-your-ground protections to allow the right to use a gun or other deadly force in self-defense in situations outside a person’s home or business.[28] It applies when "deadly force is immediately necessary to protect [...] against death, serious bodily injury, kidnapping or sexual intercourse compelled by force or threat".[29]

It explicitly denies a duty to retreat and provides legislative protection from civil actions resulting from the use of deadly force in acts of self-defense. The PA General Assembly found that:

"Felony murder," as it's called, usually applies to cases where someone (a police officer or innocent bystander) is killed as a result of someone's criminal action. For example, a carjacking that ends in a deadly crash; because the carjacker was committing a crime, he can be charged with murder instead of just manslaughter (even if his intent was never to kill anyone).

I've never heard of felony murder being applied to a case where an accomplice in the crime is the one who was killed. Not sure if it applies. But IANAL.

Yep. If you and your buddy grab some rubber ducks (fake guns) and go try to knock over a convenience store, and your buddy get shot and killed by the dude behind the counter, you will almost certainly get charged with felony murder.

Philly has been bad on random assaults on people and the knock out game. They like to target older folks who can't fight back

This guy did. Maybe it will deter future violent attacks.
