The "doctrine of fugitive disentitlement" is completely stupid as it relates to this case. The logic is basically that if someone flees the country to avoid prosecution, he can't lay claim to the assets the government tries to seize as part of that case. How in the heck can anyone argue with a straight face that the guy "fled the country to avoid prosecution" when he's never even been in the country to begin with?? That's patently absurd on its face.

Glad to see the kiwi's not cave in to US pressure in this case. Hopefully the courts there don't allow the extradition either.
 
I cant see how a citizen of another country could be considered to have "fled" the country even if he had visited here once. Wouldnt they have to prove that he had been in the country and left it due to law enforcement trying to apprehend him? I guess that is too logical for the government though.

I'm not a legal expert, but you'd think if you're going to assert that he fled to avoid prosecution, you would need to show that he was here, and either knew or should have known he was going to be prosecuted, and that he then fled. None of those points seem to apply in this case. Seems like they're trying an absurd stretch of the law to go after him.
 
I detest the government's legal theory they used to justify the seizure and frankly civil forfeiture in general absent due process.
