Last year alone, the IRS caught 80,000 similar claims for so-called black refunds, which would have cost the federal government nearly $3 billion if the bogus claims went undetected.

And many of them do.

The IRS admits that some of these fraudulent claims are mistakenly paid. No one at the IRS wants to say how much. But at the trial of Vernon James, some of the truth was told.

James was responsible for 300 bogus claims for reparations, and in his case, the IRS mistakenly paid out $1.2 million.

An IRS official testified that the fraud slips by IRS processors for one simple reason: The agency cannot check every claim on every single return, and still process the nation's tax returns in a timely manner.

Even so, IRS Commissioner Charles Rossotti says he wants the money returned.

"We will go out and get that money back with interest," he says. "And if necessary, we will go to court."
