Kids suspended/expelled for playing with airsoft guns

The stupidity continues. How long before kids are expelled because they played COD?

A suspended seventh grade Virginia Beach student will find out soon if he is expelled for the rest of the year for shooting an airsoft gun.

Like thousands of others in Hampton Roads, Khalid Caraballo plays with airsoft guns.

Caraballo and his friend Aidan were suspended because they shot two other friends who were with them while playing with the guns as they waited for the school bus.

The two seventh graders say they never went to the bus stop; they fired the airsoft guns while on Caraballo's private property.

Aidan's father, Tim Clark, told WAVY.com what happened next lacks commons sense. The children were suspended for possession, handling and use of a firearm.

Khalid's mother, Solangel Caraballo, thinks it is ridiculous the Virginia Beach City Public School System suspended her 13-year-old son and Aidan because they were firing a spring-driven airsoft gun on the Caraballo's posted private property. "My son is my private property. He does not become the school's property until he goes to the bus stop, gets on the bus, and goes to school."

The bus stop in question is 70 yards from the Caraballo's front yard.

Solangel Caraballo was not at home when this incident occurred. She was taking her young son to a Head Start class. She left her 16-year -old daughter in charge.

Khalid and Aiden aren't only suspended, they were recommended to be expelled for a year for "possession, handling and use of a firearm."

Fail.

1) it isn't a firearm. The school is being retarded, again.

2) Kids are never "school's property." EVER. The parent isn't being very smart here either.

If they weren't at school or on school ground, it's retarded.

On the other hand, people should understand that airsoft pistol still CAN (and potentially seriously, if you get shot in the eye or something) hurt, and stop fucking around.

I could maybe see a 3 day or a week suspension if they did this on school property. But I'm not sure I'd totally trust 13 year olds either, and 70yards, they could have been at his house shooting at them while the ones they hit were at the bus stop, in which case they definitely need to be punished, but a year is too much unless this is repeated violation or they were intending to seriously harm someone like aiming for eyes/face).

You sound just as stupid as the school district. You can't be serious? *roll eyes*

Man! I had so many guns while I was in school it was ridiculous. I would have been suspended. My parents would most likly sue their fat fucking asses off though. FUCK THEM!

At first read, I was OK with the suspension as I thought they shot two friends who were at the bus stop waiting for the bus, but after a second read, it sounds like they were all on private property.

1) if it doesn't happen in the school area, there should be no school consequences, unless it's part of a school bullying dynamic, but in that case you address the bullying not the use of soft air guns outside of school. Those were his friends anyway.
2) it's not a firearm, a weapon maybe depending on legislation.
3) expulsion over bullshit with no consequences is stupid, it should be suspension at worst.

When I went to school they counted the bus (not sure about the bus stop) and school grounds (even the parking lot) as fair game. Had a gun in your car in the parking lot? Expelled.

This isn't a mystery either.

Airsoft guns are replica firearms. Not sure how that works legally but clearly the school is taking a stand here.

well seeing as the kids were not on the bus or at the bus stop that point doesnt really matter

are they going to start expelling people for playing paintball and airsoft on the weekends as a hobby now as well? its total BS

school should not be able to punish a student for something that happens away from school.

this is insane. so if i post pictures of my kids with a hunting rifle they can get suspended? pfft

read the rest of the article. someone called 911 even knew it was not a real gun, cops arent doing shit because its not a legal issue

This is a police matter in which the police would tell them it is a civil matter and then the parents kids who got shot would have to decide how far they want to take it. I'm sure the two kids who shot the airsoft guns are little angles in that neighborhood so they should bake them a cake.

The school has nothing to do with it.

Bullshit.

Cannot wait to have kids and be their schools worst legal nightmare.

Except wait, I'd evaluate the schools and not send them to a shitty government funded liberal brainwashing camp in the first place.

Its what parents are demanding. There have been outcries that schools didn't do enough to prevent school shootings when there was social media evidence that the person was unstable or did this and that outside of school property. In response schools have been extending the reach of their monitoring and actionable instances.

Social media monitoring for schools is a huge business now and that often takes place outside of the school

well seeing as the kids were not on the bus or at the bus stop that point doesnt really matter

It seems the justification was that they were close (within 10 feet) and actively moving to\from the bus stop so the school claims they they have jurisdiction to ensure students have the safest possible environment to travel to and from school.

I agree it certainly seems like a reach but would be interested to see a legal opinion given that students were being 'shot' while trying to go to school. I don't think the school should have to act but in this day and age where parents scream that schools have needed to do more and more to prevent things like bullying and school shootings the trend certainly seems to in their favor

The school risks lawsuits either way. I'm betting the thinking goes something along these lines:

Its cheaper and doesn't grab national headlines to over-react and suspend someone than to do nothing, have someone die and face national scrutiny and sky high lawsuit payouts

I can't see any lawsuit risk for the school over kids playing with airsoft guns in their yard. The incident was called in that way. Airsoft guns. The children of the person who called it in were participating in the airsoft games. They were well aware it was toys.

They called it in because they are anti-gun, imo.

The letter from Delaney says one child "was only 10 feet from the bus stop, and ran from the shots being fired, but was still hit."

An over reaction by the school to suspend for a year, but they do need to be punished. Sounds like they were taking shots at the kids waiting for the bus besides just the target practice.

OT: If you really want some stupid shit, read up on the HIPPA laws and how your teachers can be sued directly by parents for them even giving out descriptions (not even a name) of students. The government is getting out of control and making criminals out of everyone. For their own safety I'll be sure to completely discourage my boys from pursuing careers in education, even if they're willing to accept half the pay they could get from working in private industry. No wonder the public education system is so messed up. Hell, when I was a kid the Principle had the option to paddle your ass. We need to bring that back now.

Airsoft guns aren't the safest thing for kids to shot at each other. A school bus stop is school property, as it's where some students are required to congregate.

Lol. The corner of my parent's lawn is school property? Awesome. I guess we can't do shit when the run around playing tag either and hide in our bushes. I'll send the bill to the school 🙄

Kids are kids, it's like they can't do anything without being labeled violent or a sociopath. I won't be surprised when "Recess" is just them having their necks tied to a device that resembles a horse walker.

Now remember, no playing cowboys and indians! That's Racist!

if it's specifically a school bus, I understand, but not public buses.

Every one of the idiots at the school or school district that had anything to do with the suspension/punishment/expulsion should be immediately fired for obviously being a complete moron incapable of teaching anyone anything.
