If the GOP had 100% party discipline, the GOP might have been able to stop her confirmation, the GOP did not, and that ends all Kegan arguments.

Its somewhat ironic to note, GWB had to wait until his second term to get his first chance to pick someone for SCOTUS, but Obama has got two picks not even half way through the first term. But thus far no Obama pick has changed the "Balance" of SCOTUS, but I predict a hell of a fight if Obama ever gets a pick to replace Scalia, Thomas, Roberts, or Alito. And maybe not so big of a battle but still a bruser if Obama gets to pick a replacement for Kennedy.

wtf kind of bullshit question is that? you should be probing her views in interpreting the constitution, not asking completely useless questions.


personally i think if you're going to be a judge on the USSC, you should at least have some experience being a judge prior to appointment. but i guess it's worked ok so far :\

Like about a third of all Supreme Court Justices, IIRC? That counts for a lot less than whether they're radical ideologues like the radical right 4 (who did sit before) we have.

Silly Kagan , she should have simply said, I want to 10o% support the GOP tea bag movement as an activist judge. 41 out of 41 GOP votes in the Senate for for sure.
Why be a wolf in sheep's clothing like Roberts and Alito, and be the GOP fantasy dream scenario number one all wrapped up in a single person.

The really sad thing is how politicalized Supreme Court nominations have become. Even twenty years ago there might have been a lot of bluster about a candidate but nearly every Senator would vote for confirmation in the end- 90 to 5 votes (or so) were the norm. Since the Bill Clinton era it seems like EVERY Supereme Court nomination has been decided almost strictly along party lines. It's a sad state of affairs.

Terrible choice. Read her wiki page. Doesn't believe in free speech, thinks NRA is bad guy and that's just first two rights. She's also a police statist...renditions and whatnot.

I wish Obama sent up true liberals in Warren or Burger mold.

Yes, just like Obamacare and the financial reform bill. This is the new Washington climate, we have to actually vote for and pass this stuff before we can open it up like a big, shiny Christmas present so we can see the horrors inside.

Both of whom were Republican appointees (as is Stevens who Kagen replaces); Burger wasn't a liberal, but ya, that's what we need.

The Republicans who appointed Berger and Warren would be considered "liberals" now.
