Defendants will distribute the Net Settlement Fund by providing a discount at the cash registers of all KB Toys, KB Toy Works, KB Toy Outlet, Toy Liquidator and KB Toys Express stores nationwide, including Guam and Puerto Rico, equal to 30% off all qualifying purchases of $30 or more during October 8-14, 2003. This distribution (the "In-store Distribution") will be done without requiring a request of any store customer and will be separate and apart from, and in addition to, any previously planned promotional events for 2003. Defendants will not advertise or otherwise promote the distribution in advance of the In-store Distribution. Signs detailing the terms of the In-store Distribution, however, may be displayed in or around the stores during the In-store Distribution and up to 48 hours in advance of the In-store Distribution.
I wonder if they will mark up or hide their more expensive/popular products (ie: videogames)? At any rate, it looks like you have to go in and ask for the discount.

And is this 30% off the normal full retail price or 30% their everyday price which they usually say has been discounted by about 30% already?

looks like a good deal - 30% off everything automatically, and they can't mark up prices in anticipation of this :)

Apparently, KB had "competitors prices" printed next to their "low" prices.
It seems like thier "competitors prices" were basically made up and higher than what most retailers actually charge.

Well the plaintiff accused that KB's use of the black price (MSRP I believe) did not accurately reflect the actual "market" price of the item. "NOTICE OF HEARING ON PROPOSED SETTLEMENT

A settlement hearing (the "Final Settlement Hearing") will be held on October 1, 2003 at 10:30 a.m. before the Honorable Thomas P. Quinn, Circuit Court Judge, in Room 2410 of the Circuit Court of Cook County, Illinois, 50 West Washington Street, Chicago, Illinois, 60602. The purpose of the Final Settlement Hearing will be to: (1) whether the Class should be certified; (2) determine whether the proposed Settlement Fund consisting of $3,000,000 is fair, reasonable and adequate and whether final judgment should be entered dismissing the Action as to Defendants on the merits, with prejudice, and without costs; and (3) consider the petition by Class Counsel for payment by Defendants of a reasonable attorneys' Fee and Expense Award in addition to the Settlement Fund. The Court may adjourn or continue the Final Settlement Hearing without further notice to the Class."

First of all, that seems pretty lame, since nearly all stores do that, that's what the "MSRP" is for. If every store charged "MSRP" directly, then they would all be investigated for price-fixing.

What I want to know is - can I get these lawyers to go after grocery stores that force the use of, and extraction of customer data from, those "Shopper's Cards"? It's pretty clear that stores have arbitrarily raised their prices on goods up to 500% (in some cases), in order to make the "savings" look arbitrarily higher, while at the same time raising costs prohibitively on basic essential food staples for those that choose not to whore themselves to corporate marketing investigators.

PS. If this works to get me a PS2 for cheap, then this deal is HOT!

edit: PPS. Most of the time, the local TRU *was* charging MSRP for most games, that were cheaper at K-B. Systems, well, those are all price-fixed anyways by the mfg.

It seems noone has pointed out the big clause in this case, and that is that this deal will exclude any items that have previously planned promotional events. So they could have promotional events for every big dollar item they sell that week. They could place all those items on sale by $5 off for that time period to avoid a huge loss.

I worked for KB a long time ago. The labels would come to us marked down in red. It implies that there was a recent price cut on the item, when one was never made.

Hell, the whole store looked price slashed.

You misread it.

That is not how I interpret that clause. Is there a clause that I missed?
