Just got a PAULA - anybody know if I can fight it?

My roommate wanted to go to a friends house and I agreed to give him a ride. We had a case of beer in the car. I got pulled over for a broken taillight and they saw the beer. They made me and my roommate take a breathalyzer test. I dont drink so I was fine. My roommate did not blow anything either. They ended up giving me a Possession of Alcohol under the Legal Age. I really dont want this on my record and I also dont want to pay $315. Is there anyway I could fight this since it was not my beer and I dont even drink? Any advice would be appreciated.
 
I think your out of luck........ you got caught with the goods......... pay up and be done with it.

No, because you are underage, and you were possessing alcohol. It sucks, especially that fine, sounds harsh.
 
You can fight it but... good luck.

You are a minor
A vehicle you were in control of had alcohol in it

Therefore you were a minor in posesson of alcohol

You need a lawyer, and, this is no joke, one who is more or less on a first name basis with the Justice of the Peace or Circuit Judge before whom you'll be going. That is to say, someone who know the exact and very systeim initimately through which you will be processed.

A long ways from home, my friend? With no direction home? Got balls? Got initiative? This really matter to you?

Then go to the clerk of courts and ask as many functionaries as will give you the time of day and ASK, "Who should I hire to defend me?"

Hate to say it, saahmed, but YOU may be facing some special hurdles.

Nevertheless, never underestimate the power of direct questions, honestly asked.

 
Whether it was your or not, YOU were in physical posession of the alcohol...in YOUR car. Sure, a judge MIGHT throw it out, IF you and your roomie both testify that it was his, and you were giving him and HIS beer a ride...but I doubt it.
 
Its your car and you mentioned 'we had a case of beer'

You and him should split the ticket, and next time remember that theres a trunk the cops cant open without a valid reason... (wheres that video of what to do when pulled over...some lawyer guy made it..)
 
I believe in my state you have to be able to prove by a phone call that it is your parents or something and you are just transporting it for them, and it must be in the trunk. Same thing with open bottles.
 
Ouch here in texas your suppose to put the beers all the way in the behind the back seat or the trunk depening of your car. That suck majors bawls try and fight it off also what age are you since that could play an important part if you decide to fight it ?
 
If your going to break the law at least now your rights.

Keep the beer out of sight and out of reach. The best place is in the trunk of the car. When asked if they can search car always say no.

Exactly. You knew the law, broke it anyway, got caught, and now want to get out of the consequences of your actions? Yep, sounds like today's kids. When I did stupid stuff as a kid and got busted I owned up and paid the consequences, I suggest you do the same. You could plead guilty to the judge and ask for leniency with an explanation of the circumstances but if you try and fight it then the judge will likely impose the maximum fine. Take it like man.

Exactly. You knew the law, broke it anyway, got caught, and now want to get out of the consequences of your actions? Yep, sounds like today's kids. You could plead guilty to the judge and ask for leniency with an explanation of the circumstances but if you try and fight it then the judge will likely impose the maximum fine. Take it like man.

There is nothing wrong with trying to get out from under the charges after getting caught. Just because you were to stupid to fight it doesn't mean ever one is.

the man might go easy on you, but it doesn't mean that you didn't break the rules.
 
If you show up in court and be respectful and honest I'm sure they will at least reduce the ticket cost. Usually even with a speeding ticket if you just show up, plead guilty and kindly ask if you can have it reduced somewhat they will reduce it.
 
You could enter a rehabilation program for alcohol problems. You could join some drug and alcohol diversion program. It would look good in court. In any case that's what politicians do when they get busted, it's all spin. Look at the Kennedy who crashed recently in DC supposedly disoriented because of sleeping medication. Look at this Folley guy. That's what our leaders do. Shouldn't we follow their examples, with the exception of the Folley guy..
