If they have "proof" that you accessed the records at that time, and you have proof that shows otherwise, they are fucked and you should have a decent wrongful termination lawsuit.

Yeah, if you are presenting the story without leaving out some glaring detail, it sounds like you have an air-tight case against them for more than just wrongful termination. You'd be in line for a monster payout I think and they could be in even more trouble for doctoring records and tampering their own system.

I would think a lawyer will happily pick up this case for no up-front money.

They can probably fire you for a reason or no reason at all. Well, they gave a reason. So now they have to prove it. And that MRI documentation is interesting.

Interesting comments by others. Go find a good lawyer and sue them!

eh, OP is probably an at will employee...wrongful termination is a bitch to prove without a contract.

NY is an "At-Will" state. You can be terminated at any time for any reason, aside from the obvious protected reasons.

If this is true, and the son or whatever was trying to get him fired then why didn't they just straight up fire him and not pull this stunt?

Well, It's fairly obvious the ex-employer found out Mr Kookie posted his tale of woe here and they have silenced him with extreme prejudice.

Good riddance.
