DELAWARE, Ohio -- A former Ohio State football star has been charged in a shooting that stemmed from a road rage incident in Delaware Sunday.
James Stillwagon, 63, of Columbus, has been charged with one count of felonious assault after he allegedly shot Richard Mattingly, 41, of Kettering, in the head.
Delaware police confirmed that Stillwagon is a former OSU football star.
Officers responded to the scene of the shooting in the 100 block of East William Street at about 3:35 p.m. Sunday.
Mattingly was flown by medical helicopter to the Wexner Medical Center at The Ohio State University. He checked himself out of the hospital Sunday night, according to police.
Stillwagon remained at the scene after the shooting and was taken in to custody by members of the Delaware Police Department and the Delaware County Sheriff’s Office.
The shooting appears to have stemmed from a case of road rage between a motorcyclist and a pick-up truck, which began on U.S. Route 42 in the area of U.S. Route 33. The ongoing incident escalated on the U.S. Route 23 off ramp at East William Street, according to police.
Police said the driver of the motorcycle, Stillwagon, fired several rounds from a handgun at the pick-up truck, driven by Mattingly.
Mattingly turned on to East Williams Street and then into a parking lot, where Stillwagon allegedly fired additional shots.
Authorities said at least five shots were fired in total.
"I think initially, there was some type of cutting off or some sort of movement incident where they probably came too close to each other and instead of letting that go, they proceeded to engage in some back and forth between the both of them," said Bruce Pijanowski, of Delaware police.
Mattingly said his pick-up truck was having mechanical problems and that's why it may have seemed like he was slowing down and speeding up on the highway Sunday.
He said Stillwagon was behind him and became angry.
"He made all kinds of offensive hand gestures, and I was trying to say I'm sorry, my truck is not functioning. I'm not messing with you, I'm really not, but I don't think he got it," Mattingly said.
Stillwagon's attorney said his client was acting in self defense, and that Mattingly tried to back up on the exit ramp.
"It looked like he had a bee in his clothes he was looking for something, and it's like, what is wrong with that guy? And that's when I saw the gun … and there's cars behind him. They had to have seen it. They had to have seen him do that. I've since heard that he's claiming that I was putting it in reverse and backing it into him, which is completely untrue," Mattingly said.
"I pulled into an Auto Zone, I think it is, and rather than keep going and continue with his day, he pulled in and decided to try and kill me. He got off his bike, fired into my tires and into the passenger side of the truck. If I had a passenger there, a kid, my niece or nephew, that would have been it," he said. "He was firing into the passenger side, so I got out on my driver's side and that's when he circled around the back and continued to fire right at me, saying, 'You're dead. You're dead.'"
Mattingly was grazed in the back of the head, and said he can't hear out of his left ear.
"He tried to kill me. He's, I think, probably going to mitigate it. It turns out that he's a football hero," Mattingly said. "Every time I close my eyes, I see the gun and I can hear him. 'You're dead. You're dead.'"
Stillwagon, who has a concealed carry permit, was released from the Delaware County Jail at about 2:50 p.m. Monday, according to the sheriff's office.
Bond was set Monday morning at $350,000. He is scheduled to appear in court again on Oct. 10.
According to the Franklin County Municipal Court records, Stillwagon has been charged with speeding three times in the last ten years.
Stillwagon was on the 1968 and 1970 National Championship Ohio State teams, and was the first winner of the Lombardi Trophy.
