Jury duty questions...

1) Is my employer required to let me attend jury duty without making me use my leave/vacation?

2) How the f*** did they get my name?
 
1. He has to let you go and PAY YOU. Not leave, not vacation. Don't let him screw you, if he does turn him in to the state.

2. Oh, we know who you are. 🙂

1. is not true. In Arizona at least, my employer can't deny me the time off to go to jury duty, but my employer does not have to pay me for the time missed from work.

2. Are you registered to vote?
 
read the other thread on this, i mentioned that you should be a hostile "jure/witness" (what ever its called) to get out of it, if need be

2. DMV records. My DMV info doesn't match my absentee ballet info. Yeah, I know, DMV's fvcked up.
 
When i was at mine, one of the lawyers flat out asked, "Do any of you just not want to be here at all today or to serve on this jury. Raise your numbers (we were holding numbered signs)". About half the room raised their signs. I don't think any of them were chosen.

That stinks. In Massachusetts the employer has to pay you for the first three days of jury duty. After that the State gives you a small stipend.

I was honest the whole time, didn't raise my number at that question and still wasn't picked. They didn't pick anyone under the age of 45. Most of those they picked were retired or homemakers.

Your employer is not permitted to fire you for attending jury duty. He is also not required to pay you, but if he does, he may deduct the $40 per diem you receive for performing jury duty.

does this mean you get 40 bucks a day?

1: Varies by state. Ask your employer what the policy is. Don't expect to get paid.
2: registering to vote drops you on the Jury Duty rolls.

In CA, you get $15.00 / day. In Sacramento, they will give you a Regional Transit day pass to get you there, but you need to buy the first one. They have a "parking lot" but it fills up early, mainly by state worker who don't want to walk the extra few blocks to their parking lot.

I get out of it as I am the sole wage earner for my household and I don't have any benefits being self employed.

I don't want to get out of it...I just don't want to burn all my vacation to hear about some drunk dude that decided to rob a frat house.

Man, I TOLD YOU. In California, they draw names from the DMV (Dept of Motor Vehicles) dbase. Same with your state.

Some people are called multiple times in a lifetime to jury duty....some people are never called.

Nope, my DMV records show an old address of mine...this letter was sent to a different address.

I was talking about being picked to actually serve on the jury, not be a part of a selection pool. Were you picked to actually serve on the jury at 18?

 
Trial with a jurry of your peers is one of worst things in our law systems. All cases should be decided by a panel of judges who understand the law clearly. Not a group of ordinar citizens. We need to end this jury system now, and change to trial by panel of judges only.

an understanding of the law does not prevent judges from introducing their own preconceptions and bias to a case. you might as well say all cases should be judged by a computer which is programmed with the rules of law.
