SOURCE: CA Prop 8 held to be unconstitutional under due process and equal protection. Court enjoins enforcement of Prop 8... Will be released at 2 pm pt...
Judge strikes down 'Only marriage between a man and a woman is valid or recognized in California'...

JUDGE: THE RIGHT TO MARRY PROTECTS AN INDIVIDUAL’S CHOICE OF MARITAL PARTNER REGARDLESS OF GENDER...

DOMESTIC PARTNERSHIPS DO NOT SATISFY CALIFORNIA’S OBLIGATION TO ALLOW PLAINTIFFS TO MARRY...

Shocking! A SF judge rules that way ;) Like I said in the other thread, this has to go all the way up to the SCOTUS.

Liberal activist judges. We all know conservative judges are the correct ones.

why even have issues voted on anymore. there is always some group who doesnt like what the majority wanted and takes it to court and is over turned. helll just have judges make our laws and skip the middle-man.

The idea is to keep the tyranny of the majority from overwhelming the rights of the minority.

well my little jeezus freak neocon, the majority cant vote away the rights of the minority. The way the founding fathers set up the government was to insure as such.

Equal protection to twist tradition into perversion.

Everyone already IS allowed to marry. It's an argument of terms here. Man and Woman, anything else simply isn't the traditional term. To twist it will anger a lot of traditional people.

There are ways to avoid this fight, to drop marriage from ALL legal standing. They don't want to, they'd rather fight and create this uproar.

Like anyone gives a shit what haters think? If they don't wish to be ignored they can join us in the 21st century. Same with the creationists who are pretty much the same ignorant folks.

On an unrelated note, I've really been wanting to watch "8: the Mormon Proposition".
Anyone see it yet?

Yep, that's exactly right. If the "elite" agree with the vote of the commoners, it may stand. If they don't the judiciary will take care of it and replace it with their ruling. Very efficient.

Better yet, let's not legislate religious prejudice. Do you get the idea?

Majority opinion != constitutional. To think that vote trumps the constitution is pure ignorance or just good old fashioned bigotry.

LOL at the paranoia. Ya, 'the elite' have had a pro-gay bias they've expressed by allowing the criminalization of gay sex most of our history, until they got around to overturning it.

Why, the memo from Elite Headquarters to the judge with his instructions should be leaked from Wikileaks any time.

Yeah - I watched it with my wife a couple weeks ago. Don't waste your time. It actually could have been a compelling movie if it wasn't handled so heavy handed.
