Not only do those people have to put up with the indignity of getting sued, but there's going to be some character assassination going on too.

OK, that seems sufficient to me, and I don't think road flares would have helped.

I doubt very much they would have. the guy was drunk, talking ona cell phone and most likely high.

Well I have some road flares, all I need is a 12 pack of beer and I can do some experimentin'

The tow truck company and stalled vehicle absolutely should have 0 culpability, but I hope they make an example of the reasturant/bar. This is a classic case of celebrity privelige, he reportedly drank non-stop for 3 1/2 hours at a bar owned by Mike Shannon the long time sportscaster and run by his daughter.

I highly doubt they would have served a normal patron that much alcohol and let them drive away. And the fact that reportedly a waitress ask for his keys and mentioned the cops only makes the case against them better, they knew he was too bombed to drive.

I don't know what bars you frequent, but this is normal around here (serving a person who is visibly drunk). I don't think I'd go to a bar that would try to cut me off. We always have a designated driver and don't need people to babysit us.

Well this wasn't like a nightclub. It's a high end reasturant that serves drinks, and the average patron probably spends an hour there, has dinner and 2-3 drinks and leaves.
A high profile person spends over 3 hours there and gets bombed and is obviously intending to drive (waitress asked for keys), should be a concern.

If they didn't promptly report this incident to the police, I'd say they are in some deep shite.

The original linked article stated that marijuana toxicology tests had not been completed. Just caught the 6:00pm news: St. Louis' medical examiner stated that while there was evidence of past use, there was no evidence that Mr. Hancock was high when he crashed.

I'm not apologizing for either Hancock or LaRussa, some people who get DUI's or DWI's, celebrity or not, are given slaps on the wrist everyday in this country, it all depends on how good your lawyer is (or isn't).

Josh Hancock was honored by the Cardinals because he was a good pitcher, not because he had a drug/alcohol problem. In general, pro atheletes are honored for the way they played the game, not for how they acted off the field.

The guy is 28 years old... you can't expect someone else to be his mommy forever.

the father is not thinking clearly and lashing out in anger. i don't agree with his finger pointing, but he's clearly doing it because of a broken heart.
