Jose Padilla, remember him?

The fellow that is locked up without charges because of alleged plans to make a dirty bomb? That one?

Oh yeah, no due process. That's the one.

I wonder if anyone would care about Rhin0 if he's locked up on bogus charges and prevented from defending himself. Probably not.

Hmmm...last I heard a federal judge (appointed by Bush, no less -- friggin' activists!) had declared that holding an American citizen without trial and without representation, at the whim of the president, and without Congress suspending the writ of habeas corpus (which it obviously hasn't), was ludicrously unconstitutional. The judge gave the administration 45 days to charge him with an actual crime, which means they've got to come up with something by April 14.

Shouldn't be too tough. Conspiracy to commit murder, possibly treason, any number of charges. I don't care; put the guy away if he was up to something. Just charge him. I wish to Christ this administration would stop treating the Constitution like so much toilet paper.

Yes. And?
My curiosity, inspired by your thread actually.

I remember there used to be a "Don't worry, Bush will charge him, he respects the constitution" attitude around here when this first happened....3 years ago...

Yeah, he lives down the street. No really there is a Jose Padilla like 2 blocks down. He's really a nice guy, but he's not the one you are referring to....

Remember, yes.
Care, no.

While it may be true that Padilla is not the most sympathetic case, we should all be concerned that an American citizen has been 'detained' (thrown in jail) without charges, contact with an attorney, etc., for 2+ years. His detention appears to be clearly illegal, and I've yet to see anything suggesting otherwise.
