Typically you should be okay putting no for your current employer, but don't do it for jobs you've already left. That looks bad.
 
Just call them and ask them to clarify. Maybe they mean that before they formally offer the position they want to talk to present employers, but perhaps not right now... I don't know, but just call and explain the situation. Or tell your present employer. Or say no and look somewhere else.
 
Your current employer cant really give much information to them anyway, they can only answer the most basic of questions, like

Does he still work there? yes/no?
Would you hire him again? yes/no?

Things like that.

They can say anything they want but may be restricted by company policy (I think you mean). This is for fear of legal action by former employees. Safer to just say, "yes he worked here."
