I think that he still has some time left on his contract, but has a stipulation that he can opt out, free of charge so to say, at a certain period. It means he can sign with anyone. Including the Lakers. The Lakers can, and will, offer him max out money, though. It's up to him if he wants to take it.
Kobe currently makes $13 million a year, so just about anything any team will offer will be higher than what he's getting now. I honestly don't think Kobe will go back to LA, as he's accomplished all he could there. He's still young (27?), and I think he'd rather head to another team and help them out.
