Its official I hate insurance companies.... **confirmed**

So on June 6th I get into an accident. I was parked but my car got hit by a mustang. The mustang got in with a galant and the saturn that caused the thing initially got away scott free (though the driver was arrested for DUI and Assault and Felony Hit and Run).

Anyway so I go to my insurance company, they take their sweet time, take photo's and then say "oh we cant do anything about it, go to the other party". So I call the other parties insurance a few weeks later. Her carrier was Freeway Insurance, but Freeway goes she is not registered with us, we are a broker but she is with Western General. So I call Western General and Western General says she is not insured with us because the policy number does not match western general format. So I ask them to search the database for the "driver" sure enough they find her but her policy number is different from what's on teh police report. Oh good atleast I got somewhere. The person takes a claim and then says "John Kwon" will call you. I wait 2 weeks no call. So I call them right now and he goes " Yeah we cannot do anything to fix your car". "Damn it your partie hit my car ", then he goes "well since the original driver does not have insurance you cannot be covered, however if your insurance has unisured property damage then they should fix it". I go "I called my insurance company they washed their hands off it saying since its under your deductiable we wont fix it. But if you want us to fix it then pay your deductible and we will fix it".

So as it stands me getting a "free ride" on fixing this wont work. Looks like i need to go to a Junk Yard and get a new bumper.

What kind of insurance company are you with? You should only need to report the accident to them along with the other drivers insurance company and your ic should take care of the details. You should go back and jump on your broker.

If you made a claim on your insurance even for this low dollar accident, your rates would go up.

Glad I live in a no-fault state where people involved in an accident have to pay for other parties' damages no matter who is at fault. My insurance company will go to bat for me and chase down the other driver's insurance b/c they sure as hell don't want to have to pay for damage caused by someone else if they can avoid it.

Screw that! This basically states that "No matter how right I am, I am still wrong". If I am sitting in a parked car, in a parking lot, complying to all proper parking rules, and some irresponsible asshat slams into me, I refuse to pay one damn cent for his actions. Why should I? He hit me. He fixes my car and his own. Moral of the story - don't drive like an f-tard.

I have infinity.. I am going to call my broker and talk to them and see what comes up.

Maybe I'm not getting this. Surely you aren't saying that with no-fault, that if I'm in my VW beater and I'm parked eating a sandwich, and a guy in a new Escalade hits me, I have to pay to fix all that plastic sh!t and he just has to pay for some buffing on my metal bumper (don't on a VW, just an example)?

Maybe that's why NJ has some of the highest rates in the country?

When I had a guy try to hide is insurance info from me after running me off the road into a telephone pole simply b/c he didn't actually hit my car, my insurance company was on him like a pack of wolves--like hell they were going to have to pay out a claim for a totalled car if they didn't have to.

Edit: I don't know all the details, but I'm pretty sure there is more "intelligence" behind it than this. For instance, in my accident, the old shmuck that ran me off the road was only determined to be "75%" responsible so they were only going to pay 75%.
In NJ, there are exceptions. You rear-end me, you will pay all the damages.

Well that's what both insurance companies are saying. Mine goes "yeah your not at fault hence we wont fix it unless you pay your deductible". The other insurance company goes "you were parked and were the 3rd party to the accident. First party were the other 2 cars that got in with each other hence your not eligible to be fixed by collision my party who ultimately hit your car, since she was not the one who caused the accident the saturn was the one who caused the accident. I suggest you go try the Uninusred/UnderInsured Property at your company to fix it, if my party didnt have this she couldnt have got her car fixed.".

The fact remains that their party hit my car.. so she should be paying for it...

The saturn didnt hit anyone of us. He took a U turn onto west bound sherman way in Broad day light, and caused the accident with cars coming on west bound sherman way. I was parked on the corner. That party didnt hit any of the cars... and from my understanding he isnt considered a party in the accident. Either case I am classified as a bystander.

Whoever's car hit you is at fault and should pay.

Take 'em to court (small claims).

If you go through your insurance company, you WILL have to pay your deductable.

BTW, I LOVE insurance companies. They have paid out to me many times over what I have paid in premiums over my lifetime. :D

So you hate insurance companies because the guy who's at fault is a deadbeat a$$shole who has no coverage and the damage is below your deductible? How is that the insurance companies fault?

Let me give you an example: You are on the freeway stopped in traffic and a guy (without insurance) rams into you from behind causing you to bump into the car in front of you. Although you are not at fault, your insurance pays for the damage caused to the car in front of you. Then your insurance goes after the person without insurance.

This is how I understand it. Try researching the laws in your state. I think you may well prevail by taking the person who caused the damage (whether at "fault" or not, their car caused the damage to yours) to small claims court and it is up to THEM to go after the person who caused the accident.

Simple enough?

take the driver with the DUI to court.. he caused the accident.. well maybe he is in jail now... hopefully..

The mustang and the Galant are suing the "DUI" driver.. their attorney called me asking if I wanted to join. But I didnt want to, cause my damage isnt too bad, (just needs a newbumper) and its not like I cant drive my car, they have a reason to sue cause their cars were really damaged.

You should join the lawsuit. You are as much of a victim of the drunk driver as the other two. Like the two posters wrote if you don't do anything then stop complaining about the insurance not paying for the damages. You yourself won't even do the right thing.
