1 and 2 are are the ways to get people rid of people without having to fire them. Employees eventually quit. They either get the hint or are completely frustrated. Either way the idea is to get them to quit and screw them out of unemployment. If the employee was fired for job performance reasons(i.e.: they just suck at performing their job), they'd get unemployment in most states, but if they quit they wouldn't get unemployment in most states.

I love all this internet legal experts. Not even one asked what state did the guy work in, but all are willing to weigh in with their learned opinions as to what that state's law requires.

except in my case. my solution was from the Federal viewpoint, so 10th Amendment doesn't apply

yes, then he should report the assault to the police and who ever kicked him would hopefully get convicted of the assault

as for 'tell him to go back to his country', that would be very rude, but i don't think it breaks a law, and he of course should ignore rude people telling him to do things he doesn't want to do. also he shouldn't hang around rude ignorant mean people talking to him that way
 
I had to submit to a blood, and TB test with the city/county to work as a mere bus boy, dish washer at a restaurant in San Diego some 40+ years ago.
Frankly, I agree with this mandate, and hardly think it cost the restaurant
chain, " hundreds of dollars", to pay for my tests. Unfortunately, restaurants
can circumvent the law by using permanent temporary, or part time workers.
 
a buddy of mine from cameroon is a pizza delivery driver. been in this job for 3 years. he's a legal immigrant. he doesn't understand the laws well and told me that his new boss has been harrassing him at work.

examples:
1. takes friend off of schedule a few times a week and calls in someone else
2. tells him to go home before shift is over, even when busy
3. and this one is what gets me. boss made him go get a blood test to prove he's not on drugs. this guy doesn't smoke or do drugs.

i don't know what all goes on there. should he complain to corporate or talk to a lawyer?

Did he do the sensible thing and tell his mommy what was happening before he dragged you into it? If so I think she needs to go speak to the principal and tell him/her that the other boys aren't playing nice. Oh thats right he isn't at school anymore. Guess that leaves him 2 options.

1. Quit
2. Suck it up

Tell him welcome to America, where corporations want to know everything about you and have more power over you than you have over them. Nothing he can do about it sadly. Is it right? Not really, but it's probably not illegal either. Lot of jobs are asking for Facebook passwords and stuff now too. It's the sad reality of things. I just hope this movement does not come here in Canada.
