a buddy of mine from cameroon is a pizza delivery driver. been in this job for 3 years. he's a legal immigrant. he doesn't understand the laws well and told me that his new boss has been harrassing him at work.

examples:
1. takes friend off of schedule a few times a week and calls in someone else
2. tells him to go home before shift is over, even when busy
3. and this one is what gets me. boss made him go get a blood test to prove he's not on drugs. this guy doesn't smoke or do drugs.

i don't know what all goes on there. should he complain to corporate or talk to a lawyer?
 
If he's legal, go over the douchbag's head. Urine is normally used for drugs, its fast and MUCH cheaper.

Make sure your buddy is giving you all the facts, there are always three sides to every story.
 
A piss test will immediately tell you if there is anything in their system, pot, narcotics, benzos, stimulants, etc. Blood tests are more accurate but they take longer and cost a lot more. I think the urine cups are about ten bucks, blood test will be in the hundreds.

This is a good site that shows what they can test for and how far back the substance will stay in your system, just scroll down a bit. This is called a dip test because they dip it in your urine: Dip Test

Honestly, sounds like your friend's work may be of dubious quality or maybe has an attitude? It's possible there's discrimination going on, but I'd assume a performance problem first. Sounds like they don't want him working unless they absolutely need him, and maybe think his poor performance is a result of drug use.

Yeah, it's all legal. It's their business and they can run it like they want. His employment is probably conditional on passing a drug test whenever they feel like giving it to him; most terms of employment are.

Depending on his employment terms, (1) & (2) are pretty common especially if your friend is paid by the hour.

(3) is a very valid point as well. I used to work in a catering company and they had zero tolerance policy to drugs and alcohol. They periodically carried random on-site tests and anyone caught positive were instantly dismissed. Of course, this was stipulated in everyone's T&C so no one could argue not knowing about it. Your friend may not smoke or do drugs (whether true or not, only he knows), but the company had to objectively confirm it and not simply rely on his words.

The acts, in and of themselves, are not illegal. You can pretty much do whatever you want to an employee.

However, if you can prove that the actions are being taken because of your friend's race, religion, age, gender or sexual orientation, then that could be illegal harassment.

Unless there's no work in your region, not really much point fighting over a entry level job... Spit in the bosses' face, slander him and move on.

Way I figure is, even if he does talk to corporate, and they actually /do/ something, the boss will have a hard on for hassling this guy as much as he can within the bounds... not really worth it.

Call the manager and see what his plans are for the weekend.

all are legal and done often. he is a pizza delivery driver (i did it at 18! lots of fun and good pay) there are times when you get sent home and the schedule changed. hell thats for anyone who works in fast food.

tell him to get over it and find a better job.
