is this auction legal? (powervcr for $9.99)

I recently got a Hauppauge WinTV-Go-FM TV tuner card and need some good recording software. I have been recommended CyberLink's PowerVCR II and it looks great, but it is $129.00 for the Deluxe version. However, someone on eBay is selling it for $9.99 (Buy It Now). He has 525 positive feedback and only 2 negative, so it isn't shady, I'm just wondering how could he sell it for so much cheaper?
 
I guess it could be OEM, but Cyberlink charges the same price for the boxed version as for a download of it.

As for the $5 shipping, he mentioned this line:
This is the full version sold as a retail package or as an electronic download.

I would opt for the download... but I also find that a little wierd, I doubt this guy has a server and I doubt it is off his own connection, so it is probably the info to get it from the Cyberlink site.

If I try it I'll let you guys know and will post in the Hot Deals forum if it is legit 🙂

Buzzman - yes, but the guy keeps doing it, I think there will always be a few of them.
