I wanted to move into a studio apt with a built in desk and one that has a window. The guy at the office I was discussing this with told me that there will be one available on 8/30 (today) but in the meantime, he told me to move into this smaller, former-storage space turned into a living space apartment until today. I go into the office today and the guy isn't there, the others told me they rented out the last one to some other guy yesterday. I did sign the contract to live in my current apt for one year but I had a verbal agreement with the guy that works there and he told me he'll create a new contract on 8/30 for signing.
Did I get freaking screwed because I'll be pissed off if I have to live in this jail like studio apt with no windows and pay the same damn price

I don't think you'll get far on this one without a lawyer. Even then, I doubt you'll get far since you didn't get it in writing. Not all contracts have to be in writing, but I know real estate contracts do.. and I'm not sure how leases/rentals fit into that but you're probably screwed.

Either way, I suggest at least contacting a lawyer ASAP. Call one before this other guy even has a chance to move into the apt you were promised. Don't threaten the apartment management/landlord, just call a lawyer and see if they can help. But, if possible, do try to work it out with the landlord before making a big mess of the situation. He may let you out of your lease so you can move somewhere else if that's what you'd prefer. I sure as hell wouldn't want to be stuck living in a windowless "apartment"!!

Technically, it doesn't sound like you needed it in writing, but it will be harder to prove. http://www.law.cornell.edu/wex....php/Statute_of_frauds

Verbal contracts aren't worth the paper they are printed on.

You signed lease on shithole=you screwed

Why would you move into a storage unit? So you can get delivery from a certain Chinese restaurant?

How long ago did you move in? Unless it was months in advance, you should have been able to sign a contract for the new apartment before you were able to occupy it.

he got hosed by the leasing agent

Moving sucks. Why would you move into the storage shed and then turn right around and move again?

Either way it sounds like you are screwed. :-(

Try really hard to get a new contract, but above all keep your cool and be nice. The bottom line is that you made a really stupid mistake for signing a lease based on a verbal agreement that you will get a new one. If you want to get out of it then it may boil down to you being nice and professional.

You situation sucks and I feel for you, but I hope you learned your lesson.

Lesson: don't sign anything based on a verbal promise that the terms will change some time in the future. You're agreeing to the terms on paper, as-is.

They said he rented out the last one to some other guy...but maybe there were two open? And he already had you slated for the one he promised? I dunno. I'd clarify with the guy when you can...

get a housing inspector to inspect the former storage space you're currently living in, i bet it's not up to code. that would be grounds to break your lease.

You can probably get your apt management to move you to another apartment. They will probably charge some sort of transfer fee. Just be sure to leave a deposit on the apartment you decide to move to, to hold it. If you don't leave money they won't reserve squat.

Update:

the property manager called me saying sorry but they already gave the apt away. He tried to make me stay at my current place without expecting any sort of fuss from me. However, he did tell me there's a new slot that will be available this weekend but it's the upgraded version which costs more ($60 more per mo.)
I asked him if I can move into that one for the same price that I'm paying now at the piece of crap living space and after a 1 minute silence and hesitation, he agreed. As of right now, I'm satisfied with my side of the deal... I do have a one yr contract so when I move out in January, I hope I can find someone to sublease this to

I was not near the office when I received the phone and the office would've closed by the time I got there... what should I do tomorrow?
He verbally confirmed it and he said he'll call me when it's ready for move in but I would like to have it in writing

should have included moving to that 2nd apt on 8/30 as a clause in the lease.

yup, you're screwed, BIG TIME.

and why are you paying the same price for the smaller apt? you should have demanded a lower price because it's smaller. then pay the higher price when u move into the bigger appt.
