They can't charge you for new carpet at least here in GA. Your landlord tenant law is probably online.

Mine:
"No security deposit shall be
retained to cover ordinary wear and tear which occurred as a result
of the use of the premises for the purposes for which the premises
were intended, provided that there was no negligence, carelessness,
accident, or abuse of the premises by the tenant or members of his
household or their invitees or guests."

my cat scratched up a few parts of the carpet, doesnt look to bad but there is also makeup stains on the carpet that I will try and shampoo out. I estimate the carpet in here is about 5 years old.

Pet deposit?
Pet damage is not normal wear and tear. Is the damage in one room?

Wrong on both counts.

Tom

Please tell me how I'm wrong? Pet deposits can help cover cost of pet damage.

Pet damage is not normal wear and tear. Normal wear and tear on carpet is traffic paths, loosening, and maybe a couple of stains.

I do this everyday. His states landlord tenant laws may differ (I doubt it) but I already said that.
http://www.dca.state.ga.us/housing/Hous...grams/downloads/landlord/secsdeps.html

"As a landlord what can I deduct from a tenant's security deposit?

All or part of the security deposit may be retained by the landlord to compensate for physical damage caused to the premises by the tenant or members of the tenant's household, pets or guests. A landlord cannot retain a security deposit to cover normal wear and tear. A landlord can also deduct from the security deposit unpaid rent, late charges, unpaid utilities which the tenant is responsible for under the terms of the lease or for actual damages caused by the tenant's breach of the lease or rental agreement."

"What other types of deposits may be required by the landlord?

In addition to the security deposit, the landlord may require an application fee, cleaning fee, pet deposit and an advance rent deposit. Before paying any of these deposits or fees a tenant should get in writing what the payment is for and under what terms the payment will be refunded. Refundable pet deposits and advance rent deposits are considered a security deposit under the Georgia law."

Does a pet deposit limit his liability? No and I didn't say it did but that is the only reason I can think that you would say I was wrong. Nor did I say he would be charged full price. Depends on the condition of the carpet as stated on the move-in inspection.

If that carpet is 5 years old, you're pretty safe regardless of the condition of the carpet.

Depends on the management and the complex but most have policy like change out the carpet after 3 years, etc.

They can patch small tears when carpet cleaning but with cat hairs and considering how old that carpet is, they will replace it and not charge you.

Have the management scheduled moveout walkthrough inspection with you? You can ask them then and they should be able to tell you.

AFAIK, it varies by state. Here in Oregon it's 2 years.

It depends

If its just normal wear and tear than no

If there is wear and tear as well as large stains or other messes on the carpet than yes the tenant will get charged
but that also depends on the wear and tear as the tenant may not get charged the full cost of the carpet if they have been there long or if it wasn't changed before they moved in and there was already wear on the carpet

If your carpet has been in for 5+ years they may charge you to clean it but probably won't charge to replace it since its close to getting that done anyways

snoturtle, you sound like you work for apartment complex. I have a question, if someone lives there for 5 years and the carpet is trashed do you charge them for a new carpet?

Recarpeting your apartment won't cost that much. Here in Atlanta, average price to recarpet 1bd apt is under $500, ~$700 for 2bd, and ~$900 for 3bd apt. That's with new padding. It's less if they don't replace the padding.

Carpet cleaning is around $25 to $50 a unit.

They don't exactly use top notch carpet, and they probably have bulk deals considering the amounts they probably use.
