Is there a time limit on when a apartment can charge you for a new carpet?

I heard a while back that if you live in a apartment for a certain time that the apartment complex can no longer charge you to replace the carpet because they would have had to replace it anyway due to normal wear and tear. Dunno if this is true or not.

anyway when I moved in the carpet here was already worn, I have lived here for 3 years and have added more wear and tear and the carpet will obviously need to be replaced, Im scared that my aparment will charge me for a new carpet. People move out all the time and I see them putting in new carpet like half the time someone moves out. Are they charging them for new carpets or are they just replacing carpets because of normal wear and tear. Anyone know?

I always thought carpets were covered under normal wear and tear and therefore didn't fall under the security deposit deal.

I wish this were true but dont think so. What if someone moved into a apartment with a brand new carpet and 1 year later got stains that couldnt be removed all over it.

I'm sure this would vary by locality, so check with your state? When you moved in, did you document the initial condition of the carpet? And why don't you ask the apt mgr?

i documented the initial condition of the carpet, never thought to ask about carpet repairs at the time and dont wanna ask now because im moving out soon.

Maybe all your friends moved into apartments that were crime scenes, and they had to remove the carpet because they couldn't get the blood out.

Really, you think they just throw away perfectly good carpet when someone moves out, even if they only lived there a year?

It depends on how long the person is living there for

And no normally we don't put new carpets in when someone moves unless they are 5+ years old or got trashed by the previous tenant

Stains are not normal wear and tear. They are stains. Having stains is not a normal condition for a carpet. Unless it's in a messy house.

snoturtle, you sound like you work for apartment complex. I have a question, if someone lives there for 5 years and the carpet is trashed do you charge them for a new carpet?

They can't charge you for new carpet at least here in GA. Your landlord tenant law is probably online.

Mine:
"No security deposit shall be
retained to cover ordinary wear and tear which occurred as a result
of the use of the premises for the purposes for which the premises
were intended, provided that there was no negligence, carelessness,
accident, or abuse of the premises by the tenant or members of his
household or their invitees or guests."

Stains are not normal wear and tear. They are stains. Having stains is not a normal condition for a carpet. Unless it's in a messy house.

Question: Are garbage bags full of old vomit covered under standard wear and tear? Because I've been hearing conflicting positions on this.

there are a few spots in the living room where the cat scratched up some parts of the carpet, I can probably use sissors to cut off the pieces the cat scratched up to hide the area. We paid a pet deposit, I think $200 or $300

I know pet damage is not normal wear and tear, I was just wondering if a carpet is a certain age if they will replace it regardless of how much damage is on the carpet. Like just say we moved out and the carpet had no pet damage, would they use this carpet for the next tenant and so on? Even if the carpet is 5 or 10 years old?

AFAIK...they can only charge you for the cost of a carpet cleaning when you move out. Trying to get your whole security deposit for the carpet would only be justified if you damaged otherwise good carpet (by doing something like spilling oil based paint on the carpet, cutting up the carpet really bad while moving stuff around, or having a pet that chewed up the carpet.
