Is the city liable for damages done from a tree on the sidewalk?

I'm assuming this tree is city owned as it's on a sidewalk next to a bus stop. During the day, some tree branches fell and damaged my car pretty noticeably. The paint is scratched all over the car. I didn't even park under the tree, the wind carried the branches a little ways away to where my car was parked.

It really sucks, especially since the car is newer, but I assumed there's nothing I could do about it. Someone suggested the city is liable, but I'm not so sure they are...

Any ideas on who is liable? I'm I stuck with a overly scratched car now?

I remember seeing a commercial about a guy who has a car damaged by a tree. When he calls the insurance company, they say they are only responsible for maple trees, not oak when they fall on a car. It made me lol.

Where I'm going with this is...see if your homeowners/auto/renter's has something in it.

Ficus... what made it more amusing is that those are often small indoor plants in the US.

Agreed they are not responsible. That's your insuances job. They are responsible for repairing the area they own though.

Probably not unless you can pinpoint to some negligent act by the city (like improper trimming).
