It is possible to have windows 7 legally activated, if you got it from technet/MSDN, which would be the same thing as a retail version. The one from that ad's screenshot shows an "OEM" key though, which is NOT what you would be getting from technet/MSDN. The windows activation where it shows the product ID should NOT say OEM at all. So in this case it's not a genuine copy.

00426-OEM-8992662-00497 is the PID for a hacked copy of Win7 Ultimate using the stolen Lenovo key. That is an illegitimate copy.

Good catch.

It's always interesting how counterfeiters lie through their teeth. It's common to see "Genuine Microsoft" stamps, along with anti-piracy notices, on sites that are selling illegitmate software.

Besides the PID already pointed out above: It is possible to have a legally licenced copy of Windows 7 today if you have an MSDN or Technet Premium subscription.... However, the terms of those subscriptions are such that the licences are for your own - personal - testing and usage. So selling a computer loaded with one of these licences on it violates the terms and would also be illigitimate.

I can get Windows 7 Ultimate from my campus bookstore for $20 right now. So, yeah, it's possible.

Can that be resold under MS' licensing terms?

There's also the free Win7 Ultimate RTM they gave out to beta testers. But again, it's only for their personal use and shouldn't be transfered.
