Figure out who owns the NXX of the number you want and call that telco. Not sure how it would work if you are not in the area though, but I imagine you can probably buy it then port it over to a voip service or something. If the NXX is free, just buy the whole NXX range and setup your own phone switch.

From a private entity? If so no it would be a violation of the companies terms & conditions. However you could privately offer cash for the number.
