Is it piracy to dl a TV Show if i simply missed the airing?

So lets say i missed the ep of Ent on friday and the reairing on sat, would it be piracy if i dl'd on say sunday.

And just for kicks, would that defense stand up in court?

see, i like to download them, put em on DVD's and sell them on the street corner for the low price of $5 a show.

I would assume most of your downloading is done via Bittorrent, in which case it is illegal, because you are uploading as well as downloading.
Less illegal if you just download from something like IRC, as there's no upload involved. But get a TV card and record it yourself :p

I got all seasons of the following shows on my HD:

24, Alias, Curb Your Enthusiasm, Seinfeld, CSI, Desperate Housewives, Lost, Medium, The Coupling, Joey, Las Vegas, Friends and the OC.

Am I in trouble?
