Is it piracy to dl a TV Show if i simply missed the airing?

So lets say i missed the ep of Ent on friday and the reairing on sat, would it be piracy if i dl'd on say sunday.

And just for kicks, would that defense stand up in court?

I would assume most of your downloading is done via Bittorrent, in which case it is illegal, because you are uploading as well as downloading.
Less illegal if you just download from something like IRC, as there's no upload involved. But get a TV card and record it yourself
