like if you wanted to do a paternity test for your own personal reasons, can you steal the other person's DNA (like from a tissue or hair or something) to have the test done?
 
I don't think it's illegal to take stuff like hair or tissue, if you don't harm anyone. For instance, you could find something on clothing or whatever. I don't think you can submit it for analysis without consent or a warrant.

Don't think its illegal, but I don't think it holds up in a legal situation when the evidence was taken in such a manner
 
legal yes, admissible in court?...no

Only a court ordered paternity test would withstand scrutiny and even then, it will be an uphill battle if they have the right attorney.

anything that goes in the trash is open game....pop can, cig...etc....they throw it away, they have let go of any claim to it.

Also, consider that simply finding a hair on the ground will give you an extremely low probability of extracting useful amounts of DNA. CSI, police shows = lie. The real life investigations that use DNA samples tend to come from blood/semen/saliva/etc (even random sample saliva is iffy).


To get enough DNA from hair, each hair fiber has to have the follicle intact. This only occurs when the hair fiber is forcefully torn from the person's body. there is no DNA in hair fiber--only the follicle. Hair that normally sheds does not contain the follicle. It's kind of hard to be discreet when ripping hair from someone's head or cutting them to collect blood, or asking them to swish some salt around in their mouth and spit into a vial....
