Is it illegal not to pay time and a half for overtime?

I believe here in Illinois it depends on whether you are full time or part time. This would be based on your annual hours worked. If you work 40 a week year round you are full time. If you work any less you are part time.

It also has to do with more than 8 hours in a single day. I know we get 8 straight hours plus 4 hours at time and a half. (12 hour shifts) We do four on and three off, for a 48 hour week.

I don't see any place about movie theater employees. The only thing I see is under "Recreational Establishments" but is refuring to more seasonal type stuff where it would be closed during "off season".

The only way your going to get a real answer is to ask an Attorney. I know that's sad but have to be able to find and read the code for those laws.

It's not the law, but it's recommended if you want to keep your current employees. If the theatre has enough people and can afford to have 1 or 2 quit because they are not getting paid overtime, then they don't have to. It's just a curtesy. If you don't like it, quit. That's the freedom of America.

almost every paycheck i've ever received (i'm blanking out on a few right now...) denote how many OT hours you have worked. then it lists what was deducted in a list... fed tax, state tax, social security, etc

Jeez, I'm classified as part time but I'm working over 40 hours a week at walmart in Iowa. I get overtime here:)

Yes, I understand that, but there are a whole lot of people that don't look at their paystub and "figure out" in their heads what they'll take home. If this person only worked 1-2 hours in overtime that paycheck, that 1-2 hours could have easily been consumed by withholdings.

anything over 8 hours a day is "overtime", this does not mean you will earn time & 1/2 for it though...only time you are required to pay time & 1/2 is if your business deals with the govt, then anything over 8hrs in one day is time & 1/2.

I am a newbie. I still don't get it.

Let's say you're getting "time and 1/2" for working 8 hours. So you get paid as if you worked 12 hours?

if you do gov work, and you work over 8 hrs in one day, you will be paid time and 1/2 for it (the amount of time worked over 8rs) you work 12...you get reg time for 8 and time and 1/2 for 4
