I went to Electronic Boutique during lunch to pick up Fight Night 2004. So the guy grabs it off the rack and rings me up. I got a quick glimpse of the box and something didn't look right. When I got to my car i ripped off the cellophane and inspected the disc. It had tiny scratches on it!
So I went back in and told him about the scratches. He didnt hesitate and grabbed another box from the rack and switched the scratched one with the new one. He even pointed out that the new still had the XBOX sticker seal on the side.
That's what the other one didn't have!
He then tells me that it was probably used out on the floor! WTF!!!!!

How the hell can they do this and get away with it? If it's open and used, how can they sell it off as new?

Is this an isolated case or has anyone else experienced this with Electronic Boutique?

This is odd because EB stopped their 14-day "satisfaction guarantee" well over six months ago. Until then it was pretty accepted if you shopped there you basically got a free rental to see if you liked the game or not. Now they take no returns of unsealed games, period...

The copy you got may have been the last one in the store at some point, meaning the disc was kept behind the counter. It was probably bought, then returned - and resealed as a result. If you don't like the business practice, don't shop there...honestly, I'm surprised you didn't know this before...

The FTC may or may not have said that, but I'll bet most states have laws against it and the Attorney General would have something to say about it.

and? if i'm paying full price, it better damn well be new.
and what made it worse is it wasnt even in new condition...it had effin' scratches.
if it didnt have any scratches I wouldn't worry about it.

Maybe he works for EB? This is NOT an acceptable practice, the used product is being falsely represented as a new product.

no, I dont work for EB. I work for a very large electronics/appliance store.

Not to mention people want to be able to take an item home, use it, then return it when they don't need or want it anymore.

Then they piss and moan because Best Buy charges a 15% restockign fee on the used item they want to return. So basically it's OK for CONSUMERS to expect full price back for a used item, but it's not ok for a retailer to expect full price for a returned item.

Ok let me try. New games are supposed to sell for more money because they're brand new and unused. Used games are supposed to sell for less money because they have been used before and tend to have minor scratches or what not. Now let's say X game sells for $10 new and $5 used. The store sold him a used copy of game X for $10 instead of $5.
Perhaps I can make it more simple for you. Take a car with 5 miles and the same year/model car with 100,000 miles on it. Obviously, the car with 5 miles would sell for a lot more money than the one with 100,000 miles on it. Now someone would be very upset if they paid $20,000 for the 5 mile car and received the 100,000 mile car instead.

you have been institutionalized by Best Buy or Circuit City or wherever it is you work if you don't think this is a problem. full price = new.

EB and the other major game stores will take the game out of its box/case and use it to advertise that game on the rack. They put the actual disk/cartridge behind the counter. When they sell down to the final copy of that particular game, they'll reunite the game and its box and reseal it and sell as new.

I personally hate it, and would never accept that game.

Simple solution: ask for a factory-sealed copy.

End of story, end of moaning and complaining.

LOL...if we were in the same room I could tell you some stories about CC and BB selling things as new.

My point is that the store made good with the OP. They didnt give him a hard time or anything. Most people are willing to take open box items if its the last one. Most dont even ask for a discount.

But then again what do I know? I have only been working in retail for ten years with 7 of those being in managment.
