iPod Nano Ruined w/ Otterbox Case

Sooo I've had my 1st Generation iPod Nano for over a year and a half without any problems until a few days ago. Mainly I've been using it at the gym for weight workouts, but a while back I started swimming laps again for cardio and shoulder rehab. I've had two shoulder surgeries, one on each shoulder, one of which was last year and swimming is the best thing I can do for rotational strenghtening.

I'm a big fan of music while working out and did some research and found that otterbox makes a waterproof case that is good up to a meter (3-4 feet). There are also some headphones that can be used underwater with it. I decided I'd try it out and got it. When I first got it, I made sure the seal fit over the Nano and so I filled up a bowl of water and left the Nano in the case for a half hour and came back and there were no problems at all, the Nano was running the whole time. Later on I took it for a visit in the shower to test out the headphones and case again. No problems at all again. The next day I went to the gym for lap swim and put the Nano in the case and connected everything. I started swimming laps and the iPod worked without any problems. After about 20 minutes I was taking a breather and hit pause for a few minutes to talk to a friend and when I went to hit play, it wouldn't come on. I tried again and nothing. I got out of the pool and took the iPod out of the case and it appeared to be wet somehow. I took it out and left it out to dry assuming that some how it got wet in the case. It's been four days, I've left it out to dry and while it was drying it would flash the lcd screen white periodically. The Nano is hosed completely, from the otterbox waterproof case. After doing some research online, most people are happy with their cases and swimming, boating, whatever isn't a problem for them.

From their website, they say the following:

"Warranty claims involving personal property damage will be put through a series of tests to determine if the case has been misused or improperly cared for or if the case has manufacturing defects. Should a case be determined to have manufacturing or material defects which resulted in damage to personal property, Otter Products, LLC, at its? discretion, will either make reparation to the customer in the form of a repair or replacement of equal value."


Cliffs

- Wanted to use iPod while swimming laps.
- Researched and bought Otterbox waterproof case for swimming.
- Tested case a few times underwater and no problems.
- Swam laps for 20+ minutes without any problems.
- iPod stopped working after 20 minutes and appeared to be slightly wet in the case.
- iPod was taken out and dried and is completely hosed.

Do I have a case at all and would I be able to get a replacement iPod? I haven't written a letter/email to them yet, I just wanted to get some input from y'all to see how I should handle this.

From what I read it looks like you can make a case with them. BUT the whole "at its? discretion," kinda worries me. Just try it; you have nothing to use.

I agree, but in the lap swim pools at Gold's Gym it's hard to go lower than that unless you're swimming at the very bottom of the pool. It was on the top of my arm the whole time and never went below probably a foot and a half in the water if that.

'at its' discretion' also worries me... My father is an attorney and I've thought about putting together a letter on some legal letterhead, but that could work one of two ways, either help my case or piss them off.

I would send a normal letter first. If they give you some BS thne move to a legal letterhead and more legal sounding "please fix so we don;t have to get deeper in this..." type.

If you send a legal letter first then they will just shut down on you and say take up to court. But a opening letter from you will seem like you will work with them.

Of course he has nothing to use, the NANO is hosed.
The expression I think you meant to use is "nothing to LOSE". :disgust:
