SAPULPA - A Sapulpa man who was held in jail for 84 days before DNA evidence cleared him in the brutal rape of his then-girlfriend's 4-year-old daughter plans to sue the Creek County Sheriff's Office for wrongful arrest.

Tommy Braden's attorney, Don Smolen, of Tulsa, sent notice earlier this month that they plan to take legal action for wrongful arrest and detention, which they allege was the result of the Sheriff's Office negligence.

"From day one he's begging them to do a DNA test," Smolen said. "They said they weren't going to do that because it was a waste of taxpayers' dollars."

Braden was arrested shortly after the April 6, 2012, rape and was not released until a defense attorney, Lowell Howe, got a judge to approve a DNA test which cleared him on July 3.

The DNA evidence was a match for Patrick Edward Misner, a convicted felon who lived in the same mobile home park at the time.

"Three months later - after his life's gone to hell - the results he's been asking them to do comes up that he's not the guy," Smolen said. "Why wouldn't you do a DNA test? Even if it was him, why not do a test and confirm it? Why take three months?"

After the crime, Misner moved to the Portland, Ore., area and was arrested on an unrelated matter. He was eventually brought back to Creek County where he is being held on a $750,000 bond on charges of burglary, rape and lewd molestation. He has waived a preliminary hearing and is awaiting a trial date.

Records show Misner was convicted in 2009 of assault with a dangerous weapon in Tulsa County.

Smolen said investigators should have looked into who was living next to the little girl and should have pursued DNA testing immediately.

Records show the attack occurred in the middle of the night while the family was sleeping with the little girl at one end of the trailer and Braden, his girlfriend and their 2-year-old son at the other end.

Howe said the mother left early for work that morning and that it was Braden who found the little girl in bed naked and bleeding and called 911. Records show she was hospitalized.

According to an affidavit filed in the case, Braden noticed the little girl's bedroom window was broken and found blood on the front porch.

Investigators believe the front porch blood came from one of the family dogs that was found dead behind the residence and appeared to have been stabbed.

Howe said investigators thought the scene looked staged and didn't believe Braden was telling the truth. A lie detector test allegedly found him to be deceptive when questioned about the girl, he said.

Perhaps the main appearance of guilt came when investigators said the little girl identified Braden as her attacker.

Smolen said the 4-year-old made the statement after more than an hour of interrogation.

The girlfriend filed a protective order against Braden soon after her daughter's attack. The state Department of Human Services filed a case against the mother for failing to protect her daughter when Braden was still being held for the rape, Howe said.

Howe said the incident wrecked Braden and his girlfriend's relationship at first, but they reconciled and have since married.

Braden and Howe said DHS still hasn't dropped the deprived child case.

Braden said he and his wife did not know Misner or even recognize him.

"We had no place to live when I got out (of jail)," Braden said. "I wasn't allowed to be around. We had to go through counseling to get back together. I lost my job. I lost pretty much everything."

Braden said he was depressed while incarcerated, quit eating and dropped to 130 pounds from 190 pounds.

Smolen said the sheriff has 90 days to respond, and if not, they plan to file a civil rights lawsuit in federal court.

Current Creek County Sheriff John Davis said he couldn't comment because of the pending legal action.

Christ - I hope this guy gets every dime possible out of them. This Sheriff any anyone related to this case needs to lose their job.....

Its fucked up if it did happen but to play devil's advocate this whole story is based off hearsay from the defendant's attorney. Did the sheriff really go on record saying that?

Edit: The guy did wrongfully spend about 90 days in jail but that may be quick for this county. Who knows, but he is probably going to get some compensation.

So they went with a polygraph, which is complete bullshit, and refused DNA evidence, which is over 99% accurate? No, don't just fire the guy, send him to jail for being criminally negligent.

What a fuck-up. They don't do DNA because of what a polygraph said? Polygraphs are total bunk and inadmissible any way. They were going to have to do the DNA to get enough evidence to convict anyhow so why wait? The waiting could also have resulted in the real rapist of a 4-year old getting away. It was only just by luck that he was arrested in another state.

A lie detector test allegedly found him to be deceptive when questioned about the girl, he said.

The problem with lie detector tests is that questions like: "Did you rape a four year old?" are going to produce a different physical response than questions like "Where were you born?"

Waste of Tax dollars? They just wasted more taxpayer money than the DNA test would have cost by holding a man not guilty of the crime he was arrested for.

Then there's the problem of if the actual perpetrator will commit a similar crime before being caught.

As well as whatever possible civil award/settlement the person exonerated with DNA evidence will get from the county

The Feds need to come in and try that Sheriff for violating that man's civil rights and throw his ass in prison just like the Rodney King beaters in LA.

Almost the best part of this is DHS not dropping the case in respect to the child. Buddy of mine went through the same thing. He and his fiance left their baby with the fiances mom while they were at work. Sister of fiance, who he had never met and who never was at the moms, and who has a history of child abuse, turned up at the moms while the mom was babysitting.

They arrive back to a baby constantly crying and obviously not right, so they go to hospital. Hospital does tests, baby has broken arm. Also has older head something or other from past injury. Dr. notifies DCFS, who takes kid, and police get involved. Police keep harrassing friend and fiance, file charges. Friend and fiance keep telling police we weren't even there, have you found the sister; grandma won't speak up, it's her daughter. Police ignore them, keep trying to get them them to admit guilt.

This goes on for like 1.5 years, with DCFS keeping their newborn (thankfully my friends aunt was able to be the one to keep him). "Justice" system finally drops suit, admits they need to go after the fiances sister. And if you're still reading this...

...DCFS still kept jerking my friend and his fiance around for another .5 - .75 of a year even after the police had no case...judge apperently could do nothing or would do nothing, just kept deferring to DCFS. Finally my friend said F it, did what he needed to do to become active in Cherokee Nation, and at that point, DCFS had to relinquish kid as it became a tribal matter.

The best part was the final day of court: DCFS protests, says they always have the best interests of the kid at heart. My friend then asks to address the court, judge agrees, and friend proceeds to rip DCFS an @sshole given he was in the system himself when he was young, and saw the rediculous abuse of the system (both fosters and DCFS)...all in it for the $$$.

Insanity...

Seems like a pretty fast DNA test. I remember a major murder in my county and we waited for over a year before the results came back.

Such horrible fail all around, not only with regard to the DNA test refusal, but also for DHS -- they are still pursuing the case against the wife even though it's now pretty clear the guy who was accused was not the perp.

As a father, it can't get much worse than having your little girl brutally raped at your home, then being falsely accused of the crime, having DHS take your girl away from your family etc. Could anyone blame the guy if he went on a killing spree of those responsible after something like that?

That DNA test could have been completed in less than 3 hours.

I don't understand how people got the impression that a simple DNA test is supposed to take days to get a result.

Are lab people really that incompetent? Or are they just like Hodges in CSI?

Also lampshaded in a later episode when Hodges mentions that he's convinced everyone that most of the advanced equipment he operates takes twice as long to work as it actually does in order to get more free time.

We did DNA tests like this in HIGH SCHOOL! It didn't take fancy equipment or tons of money or tons of time -- we did during a 45 minute class!!

There's a social heirarchy in prison based on the crime committed...this guy will be at the bottom and is in for a real treat.

Look on the bright side, he could have been like Brian Banks doing hard time before he actually got his DNA test.

Sucky thing about this is, his ex-gf probably told everyone that he raped her daughter, so even if he is cleared people are still going to be stupid.
