In trouble. Need some advices

I was involved in an accident this afternoon, and it was my fault. The other party's car flipped over (thank god she was fine) and was damaged 100%. I am fine, too.
The problem is that my insurance policy expired on Octorber 4.
The police cited me with "Fail to pay full attention" (I can avoid coming to the court by prepaying the $60 fine)
What 's gonna happen next? The first thing I know is that I'm gonna pay $500 fine to VA DMV for driving uninsured. The other party's insurance company has not contacted me yet.
what are they gonna do to me? put me to jail? I'm so scared now.

Well, with no insurance, you're pretty much screwed. You not only will have to pay for the other person's car, but depending on which state you live in, you could possibly have your license suspended and be put on probation for not possessing car insurance. If you don't even have enough money to pay for insurance, I don't know how you're going to pay for the car. Best bet is to turn to your parents and try and work off the debt somehow.

Oh yeah...that too...what Amish said...get a lawyer.

But I don't think you'll be going to jail for this sort of thing. Just don't expect to be out of debt for a while...

You can expact the following:

1. You will pay out the a$$ to have her and your cars fixed.
2. Most likely you will get a citation and a point on your drivers license for causing an accident
3. You will pay out the a$$ for not having insurance

Start selling all your belongings now.

dont insurance company automatically renew your policy and send you a bill for it? and if they dont get any money from you then, they will send you a cancellation notice, etc.... you might still be covered unless you went out of your way to inform your insurance company that you didn't want to renew it when it expired.

If you still have the monthly bill laying around, I suggest that you mail in your payment right away!

The cancellation notice took effect on Oct 4. Mail in the payment wouldn't do any good now. (well, if u didn't have any accident, they'd gladly accept the late payment and renew it). I did drive 2 years with full coverage and didn't have any accidents (I did have an overspeed ticket though). Then ....

Get some legal advice, quickly (like right now, or sooner)!

Read your policy carefully. You may have a one or two week grace period during which, if you pay the premium, the policy will cover you. Be careful, because this accident may kill that option. Call the insurance company to ask how long their re-instatement policy runs.

Glad nobody was hurt. Good luck. :)

Did your policy actually lapse or did you just not make your monthly payment on time, because that can make a big difference. Most insurance companies give you like a seven to ten day grace period for late payments, but only if your policy is still active and not up to be renewed.

My mom used to work in subrogation for a major insurance company. Her main job was taking payments and making collection call for uninsured drivers who were at fault in accidents involving covered policy-holders. Basically, if your situation is anything like the ones I'm familiar with, the other driver's insurance company will pay her expenses (that's why you have "uninsured motorist" coverage), then come after you to recoup it. If you end up in civil court over this, your lawyer will work out an arrangement for you to pay back the insurance company then. If you default, at least here, they can get your license suspended and I don't even know what else.

Aside from it being illegal to drive without insurance, I don't think you're looking at criminal charges past the ticket/fine/whatever for that. But if you really don't have insurance coverage, you're looking at a big bill. :(

Take everyone's advice and get a lawyer and especially find out if your coverage really did lapse. I pay two months ahead, so even if I stopped paying in October, I'm covered through December.

Well, the SAME thing happened to a friend of mine about 6 years ago, and he's still not out of debt. Get the picture?

A. You probably won't go to jail, but there will be a hefty fine.
B. Her insurance company will sue you for every penny of the damages, and they will win. Since the incident was related to violation of the law, the state will help the insurance company get its money by hitting your paycheck, if you have one.
C. Getting a lawyer at this point is a good idea. It will make the difference between using KY and not using KY, but either way they're gonna stick it up your...

I think I have to get a lawyer. I'll make some calls the first thing tomorrow morning. By the way, what is "KY"?

KY is a water based lubricant that people use when having sex. If the insurance company is going to stick the bill up your butt, it is better to have KY. Obviously you aren't familar with American culture. These are figurative sayings. Don't take them literally.

Call your insurance company and make absolutely sure that you are no longer covered. If you aren't, the lady's insurance company will come after you. They will likely win. You will need a good lawyer to defend you so you don't get taken for more money than is justified. However, expect to pay for all her damages, medical bills, long term treatment (if necessary), and rental car fees. You just single-handedly turned this woman's life upside down. This was an accident, but keep that in mind. This is why people have to carry car insurance. The court/insurance company will make sure that you pay every cent that you owe, but they won't take it all at once. They will assess your personal worth, and make a payment plan. You may have to start taking student loans, and use any money from jobs to pay down your debt.

I'm very sorry that this has happened to you. I hope that you can get your old company to insure you. Good luck.

You gonna get KY'ed. I drove all in HS without insurance. Drove like a manic on bumper cars. None of my friends wanted to ride with me. Must have almost gotten into accidents 50 times, never did. Thank God. So I dun like to drive at all now, it pains me to do so. But, you should get a lawyer and start going to church. :(

You've gotten excellent advice here,I just wanted to add one thing... get down on your knees tonight and thank God that you didn't kill or injure this woman,she'd own everything you make for a very long time. As bad as this is...it could have been much,much worse.

but seriously, like baffled said, just thank God that nothing happened to the people involved. everything will find a way to work itself out, but if one of you lost your health in the accident, it woulda been a lot worse

I switched auto insurers on August 28 and was surprised to see a letter from my original insurer around Sept 20 informing me that I must send payment NOW or I'd lose coverage (they didn't know I changed companies). I thought I lost coverage with them on August 29, but it appears I could have gotten away without paying them for weeks and still be covered. The same thing might apply to you, unless this Oct 4 date was the final, cancellation date, not the end of the normal 6-month insurance period.
