DETROIT -- A local man attempts to sue Motor City Casino after he lost hundreds of thousands of dollars.

Italo Mario Parise, 61, said he no longer gambles, but over the past few years he has lost $673,854 playing cards, slots and gaming tables.

Parise said he is trying to recover some of his losses and believes he was brainwashed by the casino to keep coming back.

Parise's attorney, Frank A. Cusumaro claims under Michigan law, a casino should stop a gambler when he is down.

The law Cusumaro is stating, Gaming: Action By Loser has been on the books since 1961.

In Parise's lawsuit, he claimed the casino should have known of his enormous financial losses and never made any attempt to stop him.

"The visceral reflex, response is who can someone expect to get the money back that they gambled? However based on the statute we believe it is in fact a viable claim", said Cusumano

Parise went before Judge Michael Sapala in Wayne Circuit Civil Court on Friday.

Sapala threw out the case ruling Parise could not recoup the money.

"Obviously, this is very disappointing," said Cusumano.

"We are very pleased with the verdict" , said Motor City Casino spokesperson Jacci Woods.

This is the first lawsuit of its kind in Michigan.

Parise could file another claim in State Appeals Court. Cusumano said it's unclear if he will do that.

Cusumano is being ordered back to court for what he called "a hearing for sanction".

The judge could order Cusumano to pay Motor City Casino's legal bills for filing a "frivoulous" lawsuit.

I enjoy going to the casino (including the Motor City Casino). I do so fairly regularly and am a good blackjack/craps/poker player. I, however, am not stupid enough to ever play with more money than I'm willing to lose at that point, and I can't even imagine thinking that the casino should be stopping me from playing when I'm on a losing streak.

I can see a casino even when I don't lose. Suckers! I just drive right up to it and look :) No money losing first for me!

So it's the casino's job to understand the financial background of every patron now? How were they supposed to know the patron wasn't some billionaire and $673k over the span of SEVERAL YEARS was nothing more than pocket change?

Most states have laws that you cannot serve a drink to someone that is drunk. So that could be a valid lawsuit depending on the state.

If he had won and casinos made you prove your income before you gambled, could you imagine what the next lawsuit would be? "The casino wouldn't let me gamble my money! They said I was too poor! This is discriminatory against poor people and makes casinos the playgrounds of the rich!"

I like casinos and am a responsible gambler when I visit them.

I was thinking though, a lot of people can't control themselves. If people win, they get hopeful and then they go lose what they won and their whole budget.

Since it is only American to take advantage of human nature, I was thinking it would be fun to make a casino where all the games are 50/50 odds. I bet I would come out ahead just because of human hope and greed.

Some slots these days have have a 99.999999999% payout, but the casinos make a killing because people never stop playing them.

EDIT: ok that would work out to 1 penny per each 100 billion played, which is an exageration, but I have heard of the casino keeping less than a penny per thousand dollars paid and still rake in the dough.

The previous owner of the Philadelphia Eagles had a similar lawsuit a few years ago IIRC. They would fly him out to Vegas, pick him up in a limo with a bevy of hot showgirls, then fly him home after he lost a few hundred grand.
