i'm screwed by old boss

hasn't yet happened to me, but i'm sure it will.....

i did some dj work at the bar that i used to work at, dj'ing there for about 18 mos, maybe longer
another guy that also worked there and dj'd as well just got audited by the irs last week - seems the gm got pissy about having to pay taxes on us working there, and filed us as self employed for the time that we were dj'ing. so instead of filling out a w2, somehow we are on a 1099, which means that of the 4900 that was reported for my friend, the irs now wants 1800 of it!
i know my luck, i'm going to be getting an audit in the next few months as well.....what fun


anyone have any tax experience on something that we can do? since obviously, while we were dj'ing there, we were also employees of him on his normal payroll?
does it matter at all to the irs that this gm went to jail for a decent amount of time on his last restaurant for tax evasion and fraud? will that help us in anyway?

if this was the case, you should have gotten a 1099 to file your taxes on...yeah, I'd say you're screwed when caught.

i got nothing to file my taxes on from them....i got my w2 every year and that was it....didn't even think about it until now!

This happened to two of my friends. He told them he was taking taxes out, and then writing them checks. But then at the end of the year, he declared them independent contractors working for him, and they had to file independently.

I don't know if there is any rule governing the amount of audits per year. I always thought that the IRS skipped over most of the little guys who try and jack the gov for less than a couple thousand dollars. It seems like it would cost them more to verify all those claims and then commit the audit. I think they mainly go after the big fish.

But who knows, keep your fingers crossed. If you do get audited, just tell them what happened. It seems like your boss should be liable for something, that's pretty shady what he did.

This is interesting. He's claiming that you were an employee AND an independent contractor at the same time?

If you were paid for the DJ work in your regular paycheck, that would help your case.

that's what he was claming
and i got paid in cash, after each night of work, although each night i did have to sign a form saying i worked the shift, etc....

So... you got paid money and you didn't pay taxes on it? And the IRS MIGHT come looking for their money? Well I wouldn't say you're screwed, but if the IRS does come a knockin' sometime in the next 7 years, you can expect them to want their money. ;) I wouldn't go spending a lot of money.

i have no problem paying them the taxes, but i refuse to pay them as an independent business owner - which is more than 1/3 of my earnings judging by what my coworker got hit with. i have no problem having back taxes taken for the rate at which i paid my taxes normally

Well I work for the Govt and you can claim plenty of expenses. Travel to and from work is one at 31 cents a mile I believe. You also can deduct equipment expenses needed to get the job done. I test software and do research, so my computer upgrades are part of my working expenses. Basically try to take as many deductions as possible.

Ah, yeah. The difference in taxes is probably because you'd have to pay double for social security - since your employer normally has to pay the same as you pay. That does kind of suck. Sounds like your boss was a cheap bastard.

yeah I drive 70 miles a day round trip to work. I could make out if I could charge that per mile per day.

Your regular commute is not tax deductible if you are not an independent contractor/business owner.
