The cops probably were onto his security card writing operation and the thing with his cable modem was just an opportunity for him to slip up enough for the cops to get a search warrant. I mean 12 plain clothes policeman assigned to nab someone for stealing bandwidth?

I said the punishment should fit the crime.
At worst, the person is question stole a couple of thousand in service. Yet, his fines and lost property due to unconstitutional confiscation will exceed hundreds of thousands.
No one is perfect, Roger, not even you. Remember that. Someday you will screw up on a small thing too. How do you wish to be treated when (not if) that happens? Never wish an injustice on someone else that you would not want to happen to yourself in the same position.

Nearly every one of us has done something legally questionable, but the question we have to ask in such instances is simple: is the justice being served reasonable, considering the crime?

A year in prison and loss of nearly half a million dollars, to you, is justifiable, considering he occasionally used more bandwidth than he was allocated?

I guess McOwen's legal troubles were justified as well, then?

You implied that it was fair with this comment:

From a strictly legal perspective, you are correct, I suppose; however, many of us rely on other authorities than the law.

he did break the law and he should be punished, but what happened was excessive no matter how you look at it.

basically this community spent the same amount of tax dollars on this guy than they would on a drug or small arms bust. Thats ridiculous IMO.

You said he deserved it, Roger. Deserve implies something beyond the legal issues; it implies that his punishment is warranted by his actions.

Roger went to Taco bell and refilled his soda when it clearly said " No refills please".

Damm, he had to spend the night in county with all his freinds .... I will not imagine who or what got refilled there.

Heh, I took your words no more out of context that you took mine.
And I enjoyed it too, Roger, else I wouldn't have done it. I work hard on my vocabulary too, so I'm glad to see you liked it.
But I dislike people who think that our justice system is their own personal revenge network. It's not, it's about righting wrongs and making things fair. All criminals should be punished, but not all criminals deserve jail, life in prison, or the chair. Some are good people who made small mistakes. The ability to tell the difference between them and the real criminals is the very essense of justice.

That's why the legislative system still relies on the decision making process. Unfortunately, this person will likely be charged with everything under the sun (did you note that they estimated over $11,000/person in bandwidth theft? It would be interesting to see how they came across this estimate), and will likely end up in prison for what he did.

If I'm pulled over for 65 in a 45, technically I could be charged with reckless driving, arrested, and arraigned. Is that likely? No, because the cop exercises their judgement; though I may deserve a ticket, a fine, etc., I don't deserve prison time. Even using it as a threat against me is ridiculous.

This country, unfortunately, is doing too little when it comes to these issues; the justice system is becoming more and more of a retributive tool for businesses, and less and less a tool to protect society. You may disagree, and that's fine; however, I resolutely stand that it is beyond fair - it is, in fact, ludicrous that people would even expect such charges to stick. I agree that he should be legally dealt with - he should be fined; he is not exempt from the law - but not in this manner.

Theft Rob, theft.---Larceny to be exact---
He stole the service from the cable company, that is a criminal offense.
He should have been brought to jail, fingerprinted and let loose on a bond.

In my eyes, there is no difference between what he did and a common shoplifter, they both are thieves.
Just because you cannot physically hold in your hand what he stole does not mean he did not steal it.

Theft isn't such a simple crime. There is a large difference between a shoplifter and a car thief.

Keep in mind, I'm not disagreeing with you; I'm simply interested in what punishment you think fits such a crime.

Were the situation ideal, he would be forced to pay retributions (fair retributions) to the cable company. That's all the punishment that I believe he deserves. And you?

You'd like to think that, wouldn't you? Theft - larceny, depending on how long you steal for - and it's a crime against the FCC, the F stands for Federal. You're going to get shafted - and how!
